    • there is NO exposure if you simple remove your name address/ref numbers etc from docs, over 10'000 pdf uploads are here. which then harvests IP addresses off of the people that then do so..which is why we do not allow hosting sites. read our rules and upload carefully thats exactly why we say capture as JPG, redact, then convert/merge to one mass PDF. then online sites to achieve that we list do not leave watermarks.  every once in a while we have a user like you that thinks they know better...we've been doing it since 2006 with not one security issue. thank you.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I've held out on this

 

 

got a letter stating lba county court

 

 

loads of stuff on back of letter about how they have won the court case that was recently done.

 

 

Is this scare mongering or are they now going to county court

 

 

I was 2 mins over the parking time one day I believe they say this is the 3rd time they have written to me

but first time I was not at that address

and second new address they recon by a credit check

but had no letter they gave car registration that was sold two years ago

Scare mongering

 

Their case has now been appealed to a higher court, they should not be relying on that if they were to try and bring a claim.

 

Return here if they issue a N1 claim form

Parking eye have the authority to do a credit check?

Any advice i give is my own and is based solely on personal experience. If in any doubt about a situation , please contact a certified legal representative or debt counsellor..

Held out? You mean you have ignored?

 

If this is a real lba from ParkingEye then you will receive court papers shortly.

 

The only way to stop that is to give the name and address of the driver. This will then mean that PE have to send a NTD to the driver and allow them access to POPLA where the charge can get cancelled.

 

You have not named the car park owner, but you need to complain vigorously to the management and head office immediately.

 

2 mins over gives no real grace period according to the CoP that PE are supposed to follow.

 

But I fear you have left it all to late and will receive court papers...

So if I receive court papers will this go on my credit file

 

You will defend any court papers

Do not assume it is game over if court paperwork arrives

You defend the claim

Parking eye will offer aout of court settlement ignore that

It will go to a hearing transferred to your local court

Parking eye may not attend you will win if so

 

Do you really think a judge would go on there side with this you were over time by 2 mins

They got your entry time

Then exit time

You were not parked for all that time as finding space and waiting to exit car park

 

You were not parked for the duration there parking sinage will state how long parking is

There invoice or letters will state you remainded on site longer than permitted

 

They can not keep their facts straight

Ignore them you have lasted this long keep going

The codes of practice cover slight overstays as there can be no certainty of what the PARKED time was as the ANPR captures data at the time of entrance and exit to the land. They are supposed to allow 15 minutes grace to cover this.

I would be minded to write back and point this out to them and suggest they cancel the charge for that reason as you will vigourously defend any court claim. This creates a paper trail and lets them know that you are not just ignoring them but have made a decision not to entertain their stupid demands.
