      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi can anyone give me any advice please.

 

I have been into store & spoken to a vodafone phone rep today without success. I have an iPhone 5, I'm in a 24 month contract, and the battery doesn't last more than a few hours without charging again. I have diagnosed it through the apple website & the battery is faulty. The contract has 3 months left to run, and under statutory law, I would understand that with regard to durability I should expect the phone to last as long as the contract and its now not fit for purpose.

Vodafone will send it away to apple - but it might cost me £204 - I will have paid £40 a month for 24 months - and now I need to pay more. They deny that I bought the phone from them - I only bought a contract - apparently I bought the phone from apple. This is bonkers. I don't normally take issue with stuff but surely a phone that is on a 24 moth contract should last 24 months?? Not according to vodafone!

Thanks Maxx, that’s good info, in the iphone the battery is not accessible and vodafone want to charge me for replacing the whole handset - so despite the SOGA I should at least be able to get them to ONLY charge me for the battery replacement?

The best bet would be to take it to an Apple Store, or an authorised Apple repairer, if it is just the battery that needs replacing. They should be able to do it, and since it was done by Apple themselves (or someone authorised by Apple) there can be no claims that you've voided the warranty or invalidated any claims under the SOGA for other problems down the line.

If nothing else they can either confirm that it is just the battery, in which case it is a consumable item and so no claim could be made under the warranty/SOGA, or they can advise that the issue infact isn't the battery but something else, in which case you would have a claim under the SOGA against Vodafone to have it repaired/replaced for free.

I think that this thread will be applicable for my comment.

For the last couple of weeks,I have had a problem with the home button on my Iphone 5.After I had been using the phone for sometime(tethering),or even using the phone to browse the web,the home button would not work properly and the phone was getting warm.

So I finally took the phone to the Apple shop at Leeds.They took a look at the phone and told me that the battery was swelling,you could actually see the screen of the phone bending slightly.This was causing the home button to malfunction.

They checked the serial number of the phone with their records and told me the phone was out of warranty.How much I asked,£165 was the answer.

They then told me that the battery should last longer than a couple of years,so they would give me a brand new phone to replace my faulty one.I walked out of the shop with a brand new phone,but it only has a 3 months warranty with it.

So,if anyone is experiencing faults on their Iphone,I recommend to get to the Apple shop.

You will have to make an appointment if they are busy,but they will see you within a couple of hours.

I have since checked up regarding the battery,if the phones serial number falls within certain parameters,you could have a new phone or new battery.

There is also a replacement programme for faulty ON/OFF sleep button.

Before anyone asks,my phone is on contract with 3.
