    • I believe it is helpful to seek guidance from a range of places and decide on the validity of the sources and frequency of responses which are most helpful. A single voice can be a dangerous thing. As, of course, can groupthink. Scott, it feels like £4k on a solicitor for a £1.5k bill is overkill. Were we back in time I'd suggest small claims court as your claim sounds like it may be straightforward? By all means add that phrase on.       On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Don't know if this helps but my dad is 100% that both loans were for £5,000

 

 

so i guess that means the ppi is £265 because he said he can't see what else that extra 265 would be on the loan.

Okay I've updated the "more information" document so there's no personal information. I've also found a statement of all PPI charges for the 2003 loan. And I think something to do with interest for the loan. It's in the document, under the page titled "Personal Loans Report Cover".

 

I just need to workout what to put in the spreadsheet for the PPI charges. I've done the ppi questionnaire and started making copies of:

 

Personal Loan Agreement

Statements

All letter's about the PPI

 

 

I'm going to look for the 2009 loan statements to and see if I can see any PPI charges. Also how would I do a cover letter for the claim?

I can't find either of them statements xd100uk. But I've used the loan analysis spread sheet to work it out.

 

My working out:

 

Loan 1 ran for 23 months, 23months into the loan the balance is £3.683.34 according to the loan analysis.

 

All I did was take the information of the loan agreement and put it into the spreadsheet.

 

Is this right?

· The term of our PPI covers was shorter than the term of our loans and it wasn’t made clear to us that we wouldn’t be protected towards the end of the terms

 

· The total cost of adding PPI to our loans was not clearly explained to us

 

· We felt that we was being pressured into taking the covers and unable to say no

 

· We was not told how to go about cancelling our polices.

 

· We already had cover in place that could have protected our repayments but was told that we needed to take there covers out too

 

Unless you can provide proof that the polices were appropriate for our circumstances

and that we was treated fairly when you sold us the insurances,

we will expect a full refund of all premiums,

the interest that we have incurred as a result of having the PPI covers and 8% simple interest until settled.

 

We look forward to your prompt response to this letter.

if they are not 100% prepared to do court

Right ok I will get my dad to do that,

 

 

then I'll request to know how much of loan 2 was payed off for loan 1.

 

 

And well if say the claim is less then £10,000 say the 2 to 3 grand mark,

 

 

could you please tell me how much would court cost,

 

 

what would be the chances and

 

 

what would I need to do.

 

 

Or if you wouldn't mind,

 

 

your best guess as what the outcome would need and be.

I'd change it to FOS

theres no stopping you doing court

before or in place of the fos.

 

 

or don't threaten anything.

Hi all,

 

Sorry for the wait, but me and my dad have discovered a case of forgery on the copy of the 2003 loan agreement we were sent in the SAR.

 

 

We contacted the police, who said to contact the FOS.

 

 

The FOS said they will contact Halifax and give them the normal 8 weeks to investigate/explain.

 

 

After that we can either go to court or let the FOS deal with it.

 

What was forged:

 

My parents signatures

The witness signature and address

PPI Personal Loan operation signature

His name, address and the date

 

The PPI signature, name, address or date was not on the original loan agreement.

Also my parents signatures don't match the ones on the orignal loan agreement.

 

When i rang them to ask about how much of loan two was used to pay of loan one.

They said they couldn't tell me on the phone for security reasons...

even thou my dad told them I was speaking on his behalf.

 

 

they said my dad would need to come into Halifax with the agreements.

 

Would like some advice on this

I'm thinking if the spreadsheet is just a very good estimate, could I not use the outcome of the Loan analysis to workout the charges? I'm only thinking this because I'll have to write to Halifax for the information otherwise. And I would like to just get the claim off since there going to argue with my figures anyway.

Right ok I'll do that,

 

Could you give me the calculation I need to workout the % of loan 2 PPI charges to workout the rest of Loan 1 charges after loan 2 was took out.

 

Also the loan agreement for loan 1 says the charges are 5.66, but the "Halifax Insurance Paperwork" the bank sent me says it was 5.39. The paperwork has dates for the payments but I don't no what the other charges for the rest of the loan are.

 

So should I just guess and say there 5.66 for the statements i don't have since that's what the agreement says?
