    • Hello all,   I ordered a laptop online about 16 months ago. The laptop was faulty and I was supposed to send it back within guarantee but didn't for various reasons. I contacted the company a few months later and they said they will still fix it for me free of charge but I'd have to pay to send it to them and they will pay to send it back to me. The parcel arrived there fine. Company had fixed it and they sent it via dpd. I was working in the office so I asked my neighbours who would be in, as there's been a history of parcel thefts on our street. I had 2 neighbours who offered but when I went to update delivery instructions, their door number wasn't on the drop down despite sharing the same post code.  I then selected a neighbour who I thought would likely be in and also selected other in the safe place selection and put the number of the neighbour who I knew would definitely be in and they left my parcel outside and the parcel was stolen. DPD didn't want to deal with me and said I need to speak to the retailer. The retailer said DPD have special instructions from them not to leave a parcel outside unless specified by a customer. The retailer then said they could see my instructions said leave in a safe space but I have no porch. My front door just opens onto the road and the driver made no attempt to conceal it.  Anyway, I would like to know if I have rights here because the delivery wasn't for an item that I just bought. It was initially delivered but stopped working within the warranty period and they agreed to fix it for free.  Appreciate your help 🙏🏼   Thanks!

    • Hi Guys, well a year on and my friend has just received this in the post today, obviously a little scared so looking for more of your advice.  Letter from the NCC dated 1-May-2024 is as follows.......   Before deputy district judge Haythorne sitting at the national business centre, 4th floor st Kathrine's house Northampton Upon reading an application from the claimant  it is ordered that  1. The claim be sent to the county court at #### (Friends local Court) Because this order has been made without a hearing, the parties have the right to apply to have the order set aside, varied or stayed.  A party making such an application must send or deliver the application to the court (together with any appropriate fee) to arrive within seven days of service of this order.  If the application is one which requires a hearing, and a) the party making the application is the defendant: and b) the defendant is an individual, then upon filing of the application the claim will be transferred to the defendants home court.  In all other cases requiring a hearing the claim will be transferred to the preferred court.    As a result of an order made on the 1 May 2024, this claim has been transferred to the county court at ##### (friends local court)

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

sorry once again, what other thread?

 

I thought I asked the bank to refund all package fees and all charges as a matter of redress that I suffered by having that account.

 

you (or someone else) pointed out that the bank should refund all money as to put me into a position

I would be financially if they didn't mis-sell the account,

 

therefore I thought I could still argue with them saying that the package fee

and interest took me into unplanned overdraft

and therefore I request they refund the charges I incurred the following month.

 

 

Or will they not refund them and do I have to do it any other way?

sri your other thread is for credit card penalty charges

not the penalty charges on this account .

 

 

so if you could identify, that without the subscription fees to xx date,

the penalty charge levied on XX date, should not have been charged as you were not OD

then you should get it back

and it should have been part of the subscription reclaim refund.

can I claim the charges if the interest took me into unplanned overdraft

and I got charged the following month or is it only the package fee if that took me into unplanned overdraft?

 

because some months, it was the interest and the package fee that took me into unplanned overdraft.

 

 

But sometimes there was a payment that went out on the same day as the package fee and interest and

therefore it still took me into unplanned overdraft but it wasn't the fee that caused it,

it was the payment but the payment went out the same day,

so if I wasn't paying the package fee, I wouldn't have gone into unplanned overdraft.

 

can I claim all those charges that I got charged the following month for all those?

 

by the way how long do I have to reply to their letter with their response to my complaint?

now the good news, do another spreadsheet for all the bank charges plus int at 17.94%

 

Because of the amounts involved, it can be claimed that you only incurred the charges due to having the misold

 

package fee applied to your account.

 

the bank charges should be refunded as further redress , once you are sucessful with your package claim

 

You will then need to do your letter of complaint, pointing this out

you need to reconstruct your account

 

to see when this occured

you would need to match the running total of package fes to the date of the PENALTY charge

if you take that away then if you were not OD then they owe you the charge

ok thanks

I was going to just include a written breakdown of the dates the maintenance fee took me overdrawn and the dates of the charges the following month but I guess I could also do a spreadsheet with all the charges plus 8% interest :)

I am still not sure how to argue with them about the interest rate, what do you think I can say?

let them argue the interest is not what you are claiming.

to always include a copy of each statementthe charges appear on and hi-light them too.

 

 

and pop those in with the complaint letter

so the charges in the spreadsheet and ask for 17.94%?

 

also do you know how long do I have to reply to their letter,

 

it was sent on 12th November so not sure how long I've got?

Can I ask them to refund charges that were caused by the interest I paid on the overdraft plus the package fee or just the package fee?

 

I think I need to ask them first how they came up with £54 that they refunded,

 

 

because if I don't count the interest,

 

 

then the only amount that I can come up with is only £42.

 

 

But if they do count the interest as well, then it's £281.

 

I will call them tomorrow to ask first, before I do the spreadsheet, otherwise it would not be right.

no the package fees didn't cause the interest, the interest was charged for using £1300 overdraft. But I can't work out how they came up with £54 so I will phone them tomorrow first.

does anyone know how long do I have to reply to their letter?

theres no rush a month will do

 

 

so if the package fees to the particular month, put you in OD

then you can reclaim the penalty charge with int for that month.

because the package fee caused some interest

Haha thanks but I dont think I am making myself clear :(

 

I have always (well last 4 years) been using planned overdraft of £1300.

 

So always in overdraft.

 

Then every month I got charged around £20 a month for being in this overdraft.

 

This is the interest they charge me for using £1300 overdraft (so 17.94% apr for using £1300 overdraft).

 

With the interest of around £20 I also got charged the package fee of £15.

 

Now if the interest of £20 and package fee took me into unplanned overdraft

so I went more than £1300 overdrawn then I got charged extra charges.

 

I am asking if I can argue when the interest of £20 took me into unplanned overdraft,

 

can I claim the charges the next month back

 

or if I can only claim the charges back if it was just the package fee that took me into unplanned overdraft.

 

is this clearer?

so, you would need to reconstruct the account,

working out how much of that interest was the result of the package fees

 

 

if that was then deducted from the interest charged to that point,

along with the removal of the accumulated package fees to that point

 

 

should the balance then still be over £1300 then IMHO you are entitled to charge 17% int on the resultant PENALTY charge.

as theoldrouge indicated earlier £900 was the max to date the £15 fees could cost

 

so you need to knockup a quick spreadsheet from the 1st £15 fee

incrementing that £15 each month you paid it

 

then look at the month you have been levied the PENALTY charge

 

find the same month on the spreadsheet

 

take that total away from the account balance for the same date

 

if its more than £1300, the penalty charge next month will attract 17% interest.

thanks a lot for that

 

I called Natwest today and I seriously don't understand how they worked out the amount of £54.

They told me the periods they refunded but I just checked my statements and it doesn't make any sense.

 

They said I got refunded £6 unarranged overdraft fee and £6 returned item fee for statement in November 2011.

 

 

I checked the statement and what took me into unplanned overdraft of more than £1300 was the interest of £15 plus package fee £12.

 

 

if they didn't charge me those 2 amounts,

I wouldn't have gone into unplanned overdraft I guess, so that's why they must have refunded me.

 

the other amount is £6 unarranged overdraft fee that was refunded for date 27/3/2014.

 

 

I checked my bank statement but I wasn't charged £6 unarranged overdraft fee on that day?

So where did they get it from???

I don't understand.

 

Last amount is £36 unarranged overdraft usage fee that I paid on 27/8/2014 so they refunded,

I checked statement and the previous month, it was again the interest and package fee that took me into unplanned overdraft.

 

 

I guess they are taking into account the interest and package fee?

 

 

if they are, then they owe me £281, and not £54, but I don't understand where they got £6 for March 2014 from?

 

What am I supposed to do,

call them again and ask them again?

 

Or just send them the letter asking them to refund £281 based on their calculations?

i think dx is referring to breaking things down to find out the interest on the package fee alone,

then take that off the interest that has been charged.

then any interest re the package fees taking it over 1300 is a result of the package fee missell that can be claimed back with interest.

 

 

in addition to that already given back re #149 and the package fees (which you say now were 12£). if that makes sense :)
