I am aware that the Consumer Rights Act does not apply in my case as I operate a business and, instead, should rely on the Supply of Goods and Services Act and Unfair Contract Terms Act 1977. I was a little unsure as, when I read the judgement of Hashim Farooq v EVRi Parcelnet, July 2023 I presumed that,  as Farooq had supplied laptops through Amazon,  the Consumer Rights Act would not apply but the judge refers to it in Section 22 as to why the claimant should be given judgment. Have I read this correctly? The reason for not offering full reimbursement was because I did not take out insurance for the full value.  In regards to correspondence from my customer,  I have emails from her in my timeline stating that she was waiting all week and that no one attempted delivery.  I have no doubt that she will be willing to corroborate the events with a written statement.

    • I was trying to post all the paperwork that I have, namely facebook ad, messages between the seller and my son etc . But I'm getting the message that the files are to large. 
    • First of all please can you tell us the name of the seller, something about the van – age/year, mileage, price paid. How far away is the seller from where your son lives? Who do you take it to for this inspection? Are they prepared to give you a written list of the things that they found? This is very important and you may well have to get an independent inspection from somebody such as the AA. This will cost you some kind of feedback we expect that we will be able to help you get it back. I would say that if you have to bring a court claim – which is likely – then your chances of success are better than 95% but the difficulty might be enforcing the judgement against the seller. We will have to no more in order to give you better advice. Does it have an MOT? What is the date of it and who gave it the MOT? I suggest that you start taking pictures of all of the defects that you can find.   Also I am going to say that I believe that you came over from Facebook where you were already informed that we would need at least all of the information which I have requested above. It will save a lot of time and effort for everybody if you can simply come up with the things that we ask without too much delay
    • My autistic son brought a van from a private seller. ( there was 5 other cars on his drive and another van, plus loads of machanic tools in his hallway,  so he probably is a unofficial dealer).  He gave the van a once over, he checked for any warning lights that might be on, there was none. He checked underneath for any rust etc, it all looked fine. The body was rough, but you'd expect that for the age of the van.  He got his brothers machanic to give it a pre mot check, as the van was old so he expected it to have a few problems. The van is a deathtrap, the seller had blacked out all the warning lights that were on the dash,  and I mean all.  He had also painted some kind of black stuff on the underside, to hide all the damage there.   My son drove it for over 2 hours to get it home. The machanic said he's surprised my son is still alive, and an untrained eye would not of seen what the seller had done.  Iv asked the seller for a refund and for him to have the van back, but he is refusing. Is there anything we can do.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi all sorry if this is in the wrong place

 

 

I recently had my bank card used to apply for loans, £153.05 has been take first is

Loans marketing £5(contacted and refund apparently given)

PT Loans £69.95 (Search engine doesn't know who they are)

Loans Plus More £79 (unable to contact 4 emails sent no reply I don't finish work until 4lpm when there closed)

 

 

My bank (Nationwide) are saying basically they aint paying me back even though I called them as soon as I seen money was being taken(4.05pm) as someone used my bank details so I must know about it(I honestly don't know I was at work it takes me roughly 10 mins to get home from work)

 

 

So does anyone have any advice? also does anyone have contact number/email for PT loans?

Are you saying that you didn't you didn't apply for any of these loans?

And your bank card has been used fraudulently?

Who ever heard of someone getting a job at the Jobcentre? The unemployed are sent there as penance for their sins, not to help them find work!

Yes. But it seems it's down to me to get my money back since bank don't want anything to do with it

Get back onto the bank ASAP and report it as fraud, regardless what they say, TELL them that you are reporting it to them as fraud, AND they are to cancel your card and any CPA immediately.

 

Make sure you make a note of the name of the telephone jockey,a dn you mark the time you called them.

 

ALL of the money MUST be refunded, use the visa debit charge back or BCOBS, if necessary, you might as well start their complaints procedure now as well.

 

Report the fraud to Action fraud, check your credit file also and check what is on there, this should flag up any ID theft.

Thank you I have already reported it to action fraud after reading a post on here.waiting for call back from bank about getting money back. Gutted because I ALWAYS use paypal (different bank account) when buying online so don't know how.it's happened. It's also leaving me with no money until I get paid. I would never apply for loans as I've only recently started working (long term illness for 11 years) so I no my credit scoring isn't the best. My mom is.going to call loans plus more tomorrow for me and just hope I can find who pt loans are

TBH, I really wouldn't worry about contacting the Loan coys, deal with the bank, it is up to them to pursue any fraudulent activity on their cards and accounts, not yours.

 

The loan coys couldn't care less.

 

If the bank will not refund you immediately then you need to lodge a formal complaint with them, vote with your feet and open another bank account with a different banking group.

 

Whoever you spoke to earlier is clearly lacking in any form of banking knowledge!

Did you find out who PT loans are? I'm having some problems finding who they are.

 

On the bank statement it shows a telephone number, I think they are actually ML Loans (as that is on the statement too) and the amount taken was the same £69.95.

I have had the same issue. Altogether they took almost £300 from me from both Pt loans and OR loans. I contacted my bank and they cannot do anything to get the money back or stop it. They told me to contact the companies directly and managed to find PT Loans contact number for me (OR Loans is the same company). I called them and asked them for a refund and to delete my details from their systems and any affiliated systems which they agreed to and told me it will be 7 working days till my refund. I am now waiting on that. Their contact number for those needing to do the same thing; is 01403 215760 for PT Loans and 01403 215761 for OR Loans.

 

It's disgraceful they are targeting vunerable people for money and I'm shocked they are getting away with this. Good luck to anyone in the same position.

What contact number? Call your bank directly and ask to speak to the fraud team. Also contact actionfraud. Do NOT go contacting the lenders.

Any advice i give is my own and is based solely on personal experience. If in any doubt about a situation , please contact a certified legal representative or debt counsellor..

It isn't fraud. These are brokers that charge finding fees that most people are not aware of when they put in their details. Banks cannot do a thing. I am still waiting on my refund after weeks and weeks of calling and being told its with the processing team and I simply have to wait. Very frustrating but ill just keep on them.

These companies pass info around themselves and take their fees. Most are the same company.but using different names

we had money taken out of our account by pt loans and a company called blue bean beware because they are both the same company with the same phone number we are hoping to get money back we contacted them and they promised a full refund we will wait and see

well was promised money would be in bank today from PT loans aka BLUE BEAN LOANS guess what no money ive been on the phone and was told it should be in today or tomorrow what a rip off......beware of these company's....if I knew how to chargeback I would

IGNORE this company deal direct with your bank!

That is how you do a visa debit chargeback, tell them that you want a refund using the visa debit chargeback.

still no refund in bank phoned them twice today told me will be in today then asked me why I was phoning again was very rude on phone I told her it was my money they had taken and I wanted it back. I got in touch with financial ombudsmen who took my complaint and will get in touch with these 2 company's just have to wait now

I cant get chargeback as it was over £100 that was taken from bank PT LOANS took 0ne payment of 69.95 BLUEBEANS took another of 69.95 even though they are same company

 

It matters not how much the amount is? Who told you that if it was over £100 you can't get a refund?

 

As for the bank, once they have refunded you the money, vote with your feet and move your money elsewhere.

well finally got money back from PT LOANS and BLUE BEAN LOANS I spoke to financial ombudsmen they told me to phone them when I did I told them id been in touch with FO and filed a complaint against them lo and behold money was in account an hour later feels good knowing I finally got it resolved thanks for all the advice hope this helps someone else
