Last night via email Do you have Correspondence / Audit Trails of communications showing that you were in severe financial strain due to an event AFTER you took the loan? I can prove that I had to buy a new washing machine, I have my pay slips showing the emergency tax code and a letter from the tax office after I had spoken with them to get it corrected and of course I can get a copy of my vet bill. And all of this was in the first 2-3 months of 2024.  I panicked. Stupid I know and as you say, I have learned the hard way and I am not in any way denying anything that I have done wrong, but it just feels a bit unfair.  It is what it is I guess and if I have to have it on me forever then so be it. I am just so worried about the bank situation 😕

    • Hi @LilMissM   I guess you could call me our resident CIFAS Specialist - Personally have been through all of what you have and now have come out the other side when my marker fell off in May 2023. For a start Monzo may close your account but as I had a Marker for App Fraud (Vodafone ended up making a whole hoohah of the account I had with them) - I was with them and still am from Oct 2017 till today. And not once did they close my account. I actually spoke to a couple of current account providers at the time that I had accounts with - Nationwide and Barclays - Told them what was going on and provided all the evidence to them. They advised they may do so but it was highly unlikely now that they understood why it happened and what I was doing to fight it.    Anyway - On to your marker. MCB is My Community Bank?  I can say to you that on experience that On Monday you can be on top of the world then on Tuesday you whole life changes in a flash of an eye. Suddenly you cant pay your bills, Work isnt feasible and you are left with no other choice but to scrape by.  If this has happened to you, then join the club.  - Why is this important? Well Financial institutions get one whiff of potential fraud and you are guilty without a chance to respond. You found out the hard way   If it sounds like I'm waffling, I'm not - Its important to your issue. They have deemed you guilty by the fact that no payments have been made and potentially entered into a loan agreement knowing looking not to pay (Although thats how it may appear, there will always be factors against that)    First off - Questions - What Category of Marker do you have? If unsure, check my signature for a Credit File Guide which will tell you all you need to know about what Categories apply.  - When did you raise the complaint? They will have 8 weeks to respond. More on this in a mo.  - Do you have Correspondence / Audit Trails of communications showing that you were in severe financial strain due to an event AFTER you took the loan?   My next suggestions, Send this complaint to the CEOs office - CEOEMAIL.COM Let them make the decision as per the Complaint Procedure. Then if they refuse to remove the marker. take it to the FOS who can force the company to remove it if found in favour.  Some companies do need a slap or 2 once in a while to bring them down a peg. You could be looking at this right now.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

i am really trying hard to get all sorted.

 

 

on Callcredit my creit report there are a few payday lenders missing.

 

 

I understand that one or 2 have closed business so this is what i have left on my report

 

 

ONESYS FINANCIAL original amount borrowed £413 in May 2013.

i was paying monthly by step chnage but the Amount went as high as £969 in May 2013 and dropped back down to £731.

i have paid a total back of £299 but they reckon i still owe them £731.

What do i do???

 

 

LENDING STREAM LTD £300 originally borrowed. They say it is £409.

I have paid back £135 so far through step change but they want a further £558

 

 

MR LENDER £300 original, paid £45 through Step change and

also then another £15.00 to stop them sending to motormile.

They have sent to motormile who want £660 and are bullying me

 

 

ACTIVE SECURITIES LTD originally 247 money box £100 original loan, now at 212.

have paid £46 , marked as up to date on credit file but i just want to clear

 

 

,CASH ON GO LTD think was peachy loans £100.

Paid £50 but they are after another £134 according to my credit report

 

 

ADEPT CREDIT SOLUTIONS originaly Next Credit £250.00 original amount.

Paid £70 but they are after £852.

 

 

CAPITAL FINANCE ONE CFO £195.00 - CREDIT REPORT SAYS £1861.

I called a few weeks back about this and the guy says i borrowed £400.

Not happy about this

1ST STOP PAYDAY LOAN £225 original amount. Paid £76.00

Threatening to take me to court for a further £486

 

 

LIQUID ADVANCE £200 original amount - paid £45

 

 

MYJAR think was Text loan £180.00

 

 

SAFELOANS LTD think money in advance £180.00

 

 

ACCESS FAST MONEY possibly 247 money box 651658 £105.00

 

 

these are missing from my report and

i have not heard anything

 

 

i have ordered an experian report today,

 

 

could the missing ones be on there??

 

 

Please advise,

 

 

i have sent SAR's to my bigger older debts

but cant afford to send one each to these muppets

Have a readt of the payday loans forum. Youll find good info there. Also check the sticky about the govan law centres guide.

Any advice i give is my own and is based solely on personal experience. If in any doubt about a situation , please contact a certified legal representative or debt counsellor..

Moring, dont panic people are at work still sleeping etc.

 

Best bet is to start a thread for each of these. with the following information

 

LENDER

WHEN debt was taken out

Date of DEFAUKT

Who OWNS DEBT

Any CCJ or court action?

Amount

 

This will take some time to grasp but is achievable.

 

Basically you will be aiming to get the information you need ot decide who u keep paying and what and managing this yourself with free support form people here :) and dropping stepchange. You may find you can wipe some of these balances and also do reclaims on some of the charges and fees levelled on those balances!!!

 

In meantime do some reading around CCA requests and Subject Access Requests. First stage is going ot be information gathering.

Capital Finance have referred themselves to the Financial Conduct Authority in the wake of the Wonga fiasco - we are hoping that the same will happen in that they will be told to write off arrears due to the Lending Criteria.

 

It seems to me that you had several PDLs at one time and had proper credit checks been done, then no responsible Lender would have / should have loaned to you.

 

I am not sure why there are some accounts missing from your credit files - although it seems to me that a lot of the PDLs don't report.

Hmm, I don't think you should cease payment. Are all these accounts being paid via a Debt management plan or are you dealing directly with the company ?

 

Do you have arrears on all the accounts ?

 

If you are seriously struggling, then you could perhaps offer them all a token payment of £1.00 but you will most likely have to support the request for token payments with an Income and Expenditure sheet.

Then put in a full complaint to them and the FCA. If they continue to harass, then consider legal action against them. Such as in Harrison v Link.
