I disagree with your decisions.

on the copy of my agreement

the sales rep CLEARLY marked box 2 & 6 with an 'x'

stating 'sign by the two 'x's I have marked.

that I did.

HE advised ME where to sign to gain the PPI selling commission.

it is totally immaterial that later, in many forms,

notification that I had PPI was to be found in statements or policies etc etc.

as for my self employed status

I was not a company owner or employing staff

but merely working for someone else in a self employed status.

thus I would not have been able to close anything.

I still believe this make the PPI 'void' and worthless under your self employment criteria

something like:

I was not made aware that the Payment Protection Insurance was optional.

Let me clarify:

I had no idea PPI was included in the amount I was paying, the process as I thought was signing the Card documents and this was something I had to pay for the card.

If I was informed that it was optional I would have opted out.

please don't hit Quote...just type we know what we said earlier..

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

You can only go to the FOS after you have had a final answer from Santander.

Any advice I give is honest and in good faith.:)

If in doubt, you should seek the opinion of a Qualified Professional.

If you can, please donate to this site.

Help keep it up and active, helping people like you.

but it also says 'contact us with any additional info'

the Op was not an employer nor owned a business

so the PPI was worthless

the fact that the rep 'x' where to sign IS advise

I'd send dx's letter back to Santander, they will then give you a 'final' decision.

How on earth does an 'x' make for an advised sale?!

The "I was told to sign it!" argument is a non starter. Best avenue is self employment - OP should just try and get something together... accounts, tax documents... anything.

Referral to the FLA doesn't bode well (pre 2005 sale).

  • 3 weeks later...

Hi had a letter back from Santander saying they previously investigated the matter in full and a final response was issued, they also say their position remains unchanged and they have closed this file on their records.

Can you please tell me where I go from here.

thanks

Can you still complain to FOS even yhough it was regulated by FLA ?

It's just that my OH has a similar situation with a store card complaint pre 2005.

Thanks
