      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I have just received a phone call from a guy calling himself Harry, he has a pronounced "Asian" accent.

 

 

Harry claims to be a specialist advisor at Microsoft and has information that my computer is at risk.

 

 

Had these before but this time my wife answered and Harry used her first name and asked for me by my first name.

 

 

Number with held of course.

Happened to me about 2 weeks ago, stating I had a problem with my computer funny that its brand new butI just replied "oh really considering I havent got a computer" they put the phone down and havent called back since.

Had several in the past. One called back 6 or 7 times after I had told him to f off so that would have been on the 3rd call. My daughter recorded my end of the call as she thought is hilarious that I told him that after when he had indeed f***ed off he should f*** off some more.

They use skype to call you so you never get a number.

They have attempted to contact me on numerous occasions. I have done 1471 and according to whocallsme, there is mention of Microsoft. I am not sure whether they actually attempt to hack peoples information, but may be just trying to sell them security software.

 

I refuse to accept these calls and have my phone permanently on answerphone. I am registered with TPS, but that does not stop foreign calls. Even the ones that leave an English sounding answerphone message are actually based abroad.

We could do with some help from you.

I have a virtual machine to one side explicitly offnet from the rest of my computer systems for these :mad2:!!

 

I would happily waste an hour of their time on a virtual machine which has got nothing of any value on it knowing their getting the bad deal rather than me. Also can sleep at night knowing that was 1 hour or so they weren't messing up someone else's computer. Of course I record the call and the movements in the Virtual Machine on VMware ESX and send it all off to ActionFraud.

 

I may or may not in the past have also modified the firewall so the moment they did the TeamViewer or AMMY download, connected to the Virtual Machine. Changed the outbound NAT direction to load something of offensive nature. Then say on the phone "Yes this is one of the problems I've been having, please fix it for me. I'm fed of this meat spin page coming up every time I want to go into my Online Banking"

 

Really should put some of these on YouTube... The reactions I've had are quite amusing! One said they would contact the UK Border Police to have me deported to face charges of Embarrassment in the Workplace. I told him I was an illegal immigrant for 5 years and they hadn't found me yet so I probably had it coming and cut the line.

I got one of these calls at work a few weeks ago. They hung up when I said I'd put them through to our IT department. :lol:

 

Then I had one at home saying my OS would stop operating at 6 o'clock that evening as it was out of date. I said that I thought as it had windows 8 I thought it should be ok.

my father has had those but he always hands them over to me and I always have fun with them , however I can see how someone not savvy could be scammed

did a quick googly re these ms cons. saw a tel number on one of those 'who calls' sites, that has apparently been used by 'them'. seems to be from iran!
