your need to scan up all those docs you mention please

I'm going to go along the lines of

 

I never recived the court papers and when I recived the ccj papers I applied to have it set aside

 

I sent a cca request to determine weather the debt was mine and also to see if their was any ppi or charges as of yet I have not had a reply to the cca except 1 letter saying they had to contact lloyds

 

2 months later I phoned in a recorded call to follow up the cca request I was then informed they had no paperwork from lloyds and the debt is unenforceable

Hi all

 

In 2014 got a ccj from restons which I tryed to get set aside and lost and have been paying off with the amount the court set

 

Today I got a letter from them wanting me to fill out a I&e form so they can see if I can afford the payment

 

It also says that I can get a discount if I pay a certain amount and they will mark my credit file as partly satisfied

 

I take it I can ignore as don't they have to go back to court to change the amount ??

You pay what the court told you to pay. Nothing more, nothing less.

Restons will try and do whatever it takes to get more money from you. They want the bulk payment so they can get some fast cash, then sell the debt on, or close the accoutn because theyre not willing to wait for however long it takes.

Go through the court and do it. They cant say a word about it.

Sounds like there are charges and/or PPI to reclaimed?

No not yet as I don't want to open a can of worms as I have 2 debts with them which are SB in a year or so but they have not been reported on for a couple of months

 

One is a loan that I had to take PPI on if I wanted it

I did complain about that and I think they just stopped the PPI and refunded what I had paid against the loan but I remember I had to sign some paperwork to say I won't take action in the future for it

 

The other is an overdraft

awaiting the debts to be SB'd

will not stop the PPI being offset if the OC still owns the accounts.

i now got restons texting me to contact them

 

I May have a laugh and ring them and record the conversation and tell them to go stuff themselves

and if they want to vary the court order to go back to court
