DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

More calls from Spot - message left yesterday on my answerphone saying I need to call them back as they want to discuss something with me before they can process my SAR & CCA requests.

 

There should be nothing they need to speak to you about ? Do you have an email address for them ? You need to keep everything in writing unless you can record the call - do not speak to them on the phone.

 

If you do not have an email address, drop them a note and ask WHAT it is they need to speak to you about. Your requests are simple and it is their obligation to respond within the time laid down by the regulators.

I have got an email address for them

 

Then I would send them a short email - if the caller left a name then send it for the attention of that person.

 

Along the lines of :-

 

I am aware of your attempts to contact me by telephone however, it is my legal right to keep all communication to writing.

 

Your call suggests that you require to speak to me before actioning two legal requests, namely a Consumer Credit Agreement (s78) request and a further request made under the Data Protection Action 1998 (Subject Access Request).

 

With the first - CCA request, you are obliged to provide me with the documents requested within 12 working days + 2 for posting.

With the 2nd - DPA 1998 request you are obliged to provide with every piece of data you hold on me within 40 calendar days.

 

I have included the required fees.

 

I therefore do not see any reason why you are unable to fulfill your obligations without speaking to me.

 

If you believe there is something that you need confirming, then please either respond to this email or write to me.
