I think they are all as bad as each other, trying all sorts of delaying tactics, just stick to your guns, follow YOUR timetable not their's. Good luck and keep us informed.

standard sod off letter received today from Claire Morrisey,in the office of the Chief Executive,no less!!

 

Also helpfully included a financial ombudsman leaflet and advice to consult them on the problem.This was quickly consigned to "file 13" i.e. the bin!!:D

 

Letter before action for £1085 now composed and ready for the off this morning.

 

WHY DON'T THEY JUST GET OFF THEIR HIGH HORSES AND PAY UP?THEY KNOW THEY WILL HAVE TO EVENTUALLY!!;)

They are tring to save money, simple as that. They figure thatsome people, however small a percentage, will give up when they receive that 1st standard "No" letter and then more will give up when they receive the 2nd standard "no"letter.

 

They basically try as many delay tactics and "fobbing off" tactics as possible in hope that people will give up.

well,today is the deadline for CITI response to LBA-waiting on postie any time now.If nothing is forthcoming,and I suspect that this will be the case,it's off to NI courts website!!

 

Have already totted up that including new charges and interest,we are looking at £1280 between us!!

Hi there,

 

I have just received back (on my Mums behalf) over £2k from Citi, we had less problems with them than Yorkshire Bank and Lloyds TSB which are still ongoing.

 

It got as far as issuing Moneyclaim to Citi which they duly acknowledged, and then about 5 days later a cheque to my dear old Mum arrived from their Solicitors! Keep to your timetable and I am sure that you will reap the benefits

Got the complete fob off letter from Claire Morissey this morning,about how CITI are reviewing their charges and hope to be able to advise customers by the end of July.

As the deadline for repayment of unlawful charges has now come and gone without full reimbursement,I have to inform you that 2 claims in respect of the above mentioned accounts were lodged with the Northern Ireland small claims court for a combined total of £1396.24,to include interest and court fees.

 

Claim nos xxxxxxxx and xxxxxxxx

 

As service of papers to the UK mainland will take slightly longer than service to an address in Northern Ireland,CITI should expect service in the next few days,according to information received from the Court processing Office in Belfast yesterday.

 

Further to this,we still are receiving incessant calls from your Asian sub-continental call centre,who do not seem to understand what a “balance of account in dispute” means,and also what “action has been taken to recover unlawful charges” involves.

 

The number of calls,and timing of them is bordering on harassment,and should stop forthwith.We formally request that all future correspondence in connection with these accounts be conducted solely in writing,due to the fact that calls from India will be completely ignored.Please inform your call centre of this and update your records to reflect this.

Despite sending this letter to citicards,the incessant telephone calls persist.-

 

10 JULY 2006

 

Dear Sir/Madam,

 

Re. ACCOUNT NOS xxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxx

 

Despite our letter regarding ANY communication from your company, which stated that we require ALL communications in writing, your telephone calls continue.

 

This behaviour constitutes harassment; the letters stated quite clearly to you that we require ALL communications in writing for future Court use. Do not telephone us again - remove any telephone numbers you hold for us from your systems.

 

Your telephone calls are in breach of the Office of Fair Trading guidelines. If you continue with them after the receipt of this letter an official complaint, together with a log recording the times and frequency of the calls will be passed both to that office and to the Trading Standards office. For your information note that ALL telephone calls are recorded.

 

This type of debt collection method is contrary to the ‘Administration of Justice Act 1970’ in that it is intended to cause alarm and distress to the recipient. Your methods will not be tolerated. A formal complaint, containing copies of all correspondence including yours, has now been submitted to the relevant authorities. This will be relevant to questions of your fitness to hold a licence under the Consumer Credit Act, whether or not it results in a prosecution.

 

Take further note that continued telephone calls after the receipt of a request not to call may constitute a criminal offence under Section 127 of the Communications Act 2003.

 

Communicate in writing and ONLY in writing, your telephone calls will NOT be answered.

 

HOWEVER, CALLS WILL TRIGGER COMPLAINTS TO THE REGULATORY BODIES.

I have informed them that I would be informing the relevant statuory bodies if their actions persisted,but they have clearly chosen to ignore this,and flaunt the current legislation protecting the consumer.

 

I trust you will be able to assist us using your good offices to ensure Citi Cards comply both with the law,and with our legitimate requests.

This should make them sit up and take notice instead of trying to ride roughshod over people's wishes!!

Sounds ok but why not quote the legislation ?

 

Quite often thrading standards have to look up this,and either way will ask you which specific sections of the legislation you are reffering to.

 

Putting the relevant sections down will save them contacting you again for your clarification.

 

Reason I am suggesting this as on 2 occasions recently I have been asked following my complaints to quote the sections.

LEGISLATION/GUIDLINES WHICH CITI HAVE BEEN IN BREACH OF-

 

 

1 .This type of debt collection method is contrary to the ‘Administration of Justice Act 1970’ in that it is intended to cause alarm and distress to the recipient.

 

2. Continued telephone calls after the receipt of a request not to call may constitute a criminal offence under Section 127 of the Communications Act 2003.

 

3. Protection from Harassment Act 1997-

 

Every individual has a right to be free from harassment and, accordingly, a person must not pursue a course of conduct which amounts to harassment of another and-

(a) is intended to amount to harassment of that person; or

(b) occurs in circumstances where it would appear to a reasonable person that it would amount to harassment of that person

 

The offence of causing harassment is arrestable under the provisions of Section 24(2) of the Police and Criminal Evidence Act 1984 and attracts the powers associated with such offences.

 

Section 3 enables a person who is, or may become, the victim of behaviour prohibited by Section 1 to take civil proceedings against the perpetrator.

 

 

4. Breach of the Office of Fair Trading guidelines on harassment

para 2.2-sub para G-

bit of an update-

if you need to report harrassment calls to trading standards,it has to be lodged with your own local office,not the office local to the institution you are complaining about.

 

So if you're reading in,CITI,expect a letter from mine this week!!!:D

 

Anyway,the trained monkeys at CITI decided,in their infinite wisdom,to send me a default notice -ROFLMAO

 

The stupidity of this "bank" crosses new boundaries every week.

 

This is the reply I sent today-I think you can tell by the tone of the letter that I have just about had it up to here with these leeches!!

Thank you for the default notice I received today.After I had finished laughing,I decided to enlighten you somewhat as to relevant issues.

 

I am undecided as to whether CITI are -

 

a.in ignorance of consumer law

 

b.in complete denial of the pending legal action against CITI in respect of the account.

 

c.attempting to bully their customers whom they suspect are easily upset,and who take such letters seriously

 

Or indeed a combination of the 3 options.

 

I regret to inform you that options (a) and © do not apply to me,so you have wasted both your time and a sheet of paper,not to mention postal costs in sending a totally unlawful,and,therefore,inapplicable default notice.When my pending legal action is settled,my account shall be cleared.

 

Furthermore,and I do not intend to repeat myself again,your call centre insists on harassing us despite requests for this to cease and desist.These calls are being logged,and as you so helpfully advise in the default notice, Trading Standards have been fully appraised of the situation,so expect to be in communication with them very soon.

 

In the unlikely event that CITI decide to actually defend the action in court,your default notice shall be included in any evidence I present for consideration.This will demonstrate to the court that CITI have failed to even attempt to amicably resolve the issue leaving me no alternative but to resort to legal action.The court will undoubtedly be very interested to hear that CITI are seeking to subvert any legal proceedings by attempting to extract payment,not just once,but twice,of unlawful charges.

I suspect that trading standards in Salford have had quite a few letters too.

Be prepared for them making an application to have any hearing held there.

 

Your letter is quite straight to the point and if used in court should liven up the proceedings maybe giving some joviality to an otherwise formal procedure.

I don't know what it is with CITI and written correspondence, but I have written 4 times in the last 3 months to give them my new bank account details, 1 letter to my branch and 3 to the offices in Sunderland that send me letters. They obviously haven't been read as they keep sending letters saying my account is going further into arrears! I got a letter today asking for a payment within 7 days - well I've been trying to pay them for the last 3 months and I haven't got the money to pay within 7 days now!

 

They are definitely shocking with the telephone calls, my sister recently got a job working for them and she couldn't stand it, she gave it up after 2 months because of how they had to harrass people, some that simply had no money.

 

I also asked them to stop ringing me as i'm never in and father is ill and doesn't like constantly answering the phone, obviously they either haven't read that either or ignored it as I get calls from them from 8am at the earliest to 9.30pm at the latest! I know the number and don't answer it now. I have proof of postage and copies of all letters so i'll write yet another letter and see where it gets me.

might be worth contacting your local CAB.. they can put extra pressure on them to get them to stop. If not Trading Standards

 

But dont forget to make the Court aware of the breach of sect 40... a criminal action means they can rule the whole contract unlawful and therefore unenforcable!
