Chasing the balance is one thing...trying to litigate it is another...until such time they do try..... ignore them...if they do you have the perfect defence...assuming your F&FS was made watertight.

If they're denying sight of the letter I presume the details were written on the back of the cheque for them to match it to your account. When doing a F&F on this basis it's best to keep all identifiable stuff (name, account details etc) buried within the body of the accompanying letter and not on the cheque, that way they can't claim to have simply cashed the cheque and matched it to your account without having read the accompanying T&C's of the letter. Should also be done with payment via a 3rd party. Although risky I have done similar before with good results.
