  3. Yes, it is HSBC who are now contacting me directly as they are no longer using their solicitors? The CCJ was a long time ago, I can't remember when exactly but, I guess around 5 years ago? I honestly can't remember if I contested it either, it was so long ago but I can't imagine I wouldn't have
  4. Oh yes! I have sent it to them a number of times and they still keep chasing, that's why I want to present it to the court and get the order revoked

Dear everyone I had a CCJ a few years ago and, the total amount was around £7.5K I sent the solicitors concerned a cheque for £%,750 with a letter saying ti was full and final settlement They cashed the cheque and I heard nothing for a long time but now they are chasing me for the rest How do I get the CCJ removed as they accepted the cheque so I was informed by a solicitor, the debt is settled How can they now chase me again and, how do I stop them please?

Hi Fletch Yes, you are right, it is DG Solicitors Thank you for the articles, they are interesting reading I know it sounds stupid but, I even had the letter and cheque being sealed in the envelope, witnessed by solicitors and they still refuse to accept the letter ever existed I know they are trying to use scare tactics and cover their mistake so I'm more than happy to approach the courts Does anyone else have any suggestions please?
  9. I've had a recent experience and would like some advice please. I had a debt with HSBC bank which covered two separate accounts. I received a number of letters from a firm of solicitors in Birmingham with all sorts of threats and finally there were two CCJ's issued against me. I finally had some money and sent them a cheque with a covering letter. The cheque was for 5750 against a total debt of around 9k and sent an accompanying letter which stated very clearly that the offer was as full and final settlement on all accounts held with HSBC and the solicitors. The cheque was cashed After a period of a few months, I then received a letter saying that I still owed money and when was I going to pay? I wrote to them, with a copy of the letter saying full and final settlement, they now are refusing to accept the letter ever existed and, strangely, they have no letter that was sent with the cheque. They are now threatening me again and I keep telling them they accepted the payment as full and final settlement and have suggested my next step is to send all the correspondence to the county court and ask for the ccj to be removed Does anyone have any suggestions as to how I can now get them to accept they have made a mistake and the debt is legally cleared please?
  10. Sadly the Citizens Advice know about as much as I do as have already tried that route. Ive just had some more paperwork from the solicitors and the figure has risen by nearly 5K in no time at all, is this allowed? The other question is, what is the normal settlement figure? is it 50%, 60% I hope not as high as 70% Ive received a set of court papers that state the two judgements against me. The case numbers are correct but the dates are wrong, one by over 12 months Is there anything that I can do to get this case thrown out as the papers are clearly wrong and have the official court stamp? Any help on this yet please?
  11. Hi Elsa Thank you for that Having said that, I've never been asked for payment installments or had any contact with anyone since the court order, is this normal? Also, I have written to them and offered 60% of the total amount as a full and final settlement figure which would be paid by my partner as she buys me out of the house. Since writing to the solicitors, they have been very uncooperative sending letters and forgetting to enlcose documents, delaying letter replies just being a complete unhelpful bunch, is this normal too?

Hi again Well, Ive received a letter today telling me that there has been a court date set when the court will decide whether or not the charging order should continue in force and become final. Pardon my ignorance but, does this mean that when the court hearing takes place, they decide there and then if my home is to be sold? Please help, I'm petrified and need any advice possible please

Sadly it doesnt give any reason as to why the defence was struck out We have no eveidence of the split except that my pertenr paid the full deposit and has been paying the mortage on her own for the last two years while ive not been earning. What are the chances of success if I offer them a monthly payment plan to repay the amount in full over 60 months? Will this usually surfice and, if it would, do you have any coppies of letters I can send please? Also, my pertner need to write and ask them to stop with the order as its nothing to do with her, whats the best approach and is it likelyt to prevent the order? Just wondered if anyone had any advice on this please? It almost seems that they now have everything? How do I appeal, how can they take the property if I only own 10% and, it sounds like there has already been a hearing, of which I knew nothing about, and might be another one to seal the deal. How do i find out these details and, any advice on being represented please? Please help...............................
  15. The papers I received state; IT IS ORDERED THAT 1. The Defence is struck out and there shall be summary judgement for the claimant for £******* together with the costs of the claim assesed summariliry at £***** a total of £********
  16. Sorry, what county court claim form? I've never received anything since the court order was awarded
  17. Is there any way I can avoid this? What if I offered them a monthly repayment scheme, would that stop the action? As we stand, they havent contacted me to ask for any repayment at all, just gone straight for the property
  18. What if my legal share of the property doesnt cover the debt?
  19. Reading through the bits, does this mean that if I am filing for bankruptcy, they cant put this order on me? I can have documents to prove that I paid nothing toward the deposit, my partner ownes 95% of the property so, can they still go through with this if my share is minimal and wont cover the debt?
  20. Thanks Ganymede That seems very confusing to the layman! Am I assuming that they CAN add interest until the property is sold or, they can actually make me sell my portion of the property? I am surprised that I was never notified about the hearing, is this usual? The scarey thing is they have seriously affected my partner with this action and she is completely innocent
  21. Please help I had a case a while ago and lost to egg even though I thought we had a solid case. Ive just received documents to say they have put a notice of application to register a restriction against the land? The house I live in is mainly owned by my partner, I only own a small proportion but, she has also been notified that this will go ahead and there is nothing we can do to stop them. What advice has anyone please? The debt was mine, not my partners and she has notning to do with this, how can I stop them putting an order against our house? The other thing is, if they do this, will it still be acruing interest until it becomes the full value of our home and they take it away? Please please help LB
