    • when did they (who) inform you there was a 'police case' and when was this attained? i will guess the debt is now SB'd as it's UAE 15yrs. have you informed the bsnk ever by email/letter of your correct and current address? you can always ignore anyone else accept the bank,  Block and bounce back all emails. Block any text messages  Ignore any letters unless it's: - a Statutory Demand - a Letter Of Claim - a Court Claimform via Northants bulk.  
    • I left Dubai 8 years ago and intended to return. However a job prospect fell through. I’d been there for 15 years. I decided to pay my credit card and the bank had frozen my account. There is no means to pay the CC so completely unable to pay when I wanted to other than the bank advising me to ask a friend in the UAE to pay it on my behalf!  fast forward bank informs there is a police case against me for non payment. Years later IDR chased me and after months/ years they stopped. Now Judge & Priestley are trying their luck. Now I have received an email in English and Arabic from JP saying the bank has authorised them to collect debts. Is this the same as IDR although I didn’t receive anything like this from them. Just says they are authorised?
    • The neighbour's house is built right on the boundary so the side of their house is effectively the 'wall' in our garden separating the two properties. It's a three storey house and so the mortar poses a potential danger to us. Because of the danger, we have put up an interior fence in our garden to ensure we don't risk mortar dropping on us. That reduces the garden by 25% which is not only an inconvenience, but it's the part of the garden where we had lined up contractors to install a patio and gazebo which we will use for our wedding reception in less than 2 months. We have spoken to the neighbour's caretaker who is on the case, has spoken with a roofer and possibly a scaffolding company, but there are several issues. They don't seem to understand the urgency. As long as there is a risk of falling mortar, we can't carry out any work in the garden, and unless they hurry up, we're looking at cancelling our wedding as it's not viable to book a venue because we can't use our own garden! Also, they want to put the scaffolding up in our garden which would be ok with us if it was a matter of a few days and they hurried up, but there is a tree (most likely protected by the conservation area), so most likely they can only reach part of the roof with the scaffolding if they put it up in our garden. We suggested a roofer with a cherry picker but they seem to want to use a company they've used before. Any and all comments, suggestions, advice is more than welcome.  PS. does it make any difference that the neighbour is a business (ltd) and not a private dwelling?

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi everyone,

 

years ago I served the usual letters of request,

Affidavit,

Notice of Fault

and Estoppel on Marbles credit card.

 

I then obtained from [EDIT} a Notorial Certificate of Service.

 

Years on,

 

Lowells are now taking me to court over the debt.

 

Has anyone been successful in court with this type of submission and with a Notorial Service please....

 

or is this not worth the paper written on?

 

Any advice would be gratefully received.:-(:evil:

I don't quite understand "Notorial Certificate of Service"

 

Was this a personal service of a Statutory Demand or a claim issued via the County Court. We need to know if this is a Stat Demand or a MCOL Claim.

These are the template letters viz Bills of Exchange Act that I sent out ending in an Estoppel - they are lengthy.

 

After this I followed it up with a genuine Notory Public, {EDIT}, who served the papers again

a) letter of request,

2 affidavit,

3) Notice of Fault,

4) notice of default and finally

5) the Notary sent a Notice requiring a response under a notarial seal in 2010.

 

This was followed up with a Notary's Certificate of Service and Non or Inadequate Response to Marbles in March 2010.

This debt was bought from Marbles and subsequently bought by Lowells Financial.

 

What I don't know and guess this sounds stupid - is will this all stand up?

 

I've got a Form from Northants CC ..... the main administration of the courts I believe.

Ah righto, it was you that had this guy serve on Lowells (or whoever).. not the other way round.

 

Ok, well can you please let me know, what the date of issue on the Claim form from Northampton is (you have a timeline to adhere to) which is..

 

Date of Issue (top right hand side of the claim form under the claim reference) + 5 days for service = ?? + 14 days to acknowledge service = ?? + 14 days to submit defence = ??

 

TBH, from what you have described, I rather suspect that you might have wasted your money in having this solicitor serve what appears to be Freedom of the Land processes.

 

In order to advise fully, we would need other information in respect of the debt itself.

 

When did you enter into the agreement - when was it assigned/sold to Lowells.

 

Did you receive a Default Notice and did it allow you the statutory 14 days to remedy the breach.

 

Why did it go into default.

 

When was the last payment made to the account.

 

On what basis did you claim estoppel ? I think this is only relevant if a claim is made and you had an arrangement to pay with the original creditor.

Date on papers is 7th November. I received it yesterday, Sat. 9th November. The papers say I have 14 days to respond, but another if I wish to defend.

 

Yes, it is the Freedom of the Land process -- like most I got sucked in here I believe.

 

The debt was with Marbles, who sold it to SAV, who used Lowells as the Agents, and apparently subsequently purchased it ... I have no record of Lowells purchasing this debt until I got the Court papers, Honestly. Credit Card. Problems with my business at the start of the recession and now surviving but bumping along the floor of survival...... enough to keep me going but .... I'm on working tax credit now. Up to the 5th Year of default - and no I didn't question the default process - too busy trying to keep warm, fed and alive. I live alone and am about 6 years off retirement. The estoppel was part of the Freedom process.

 

Two other things for you to consider as an aside to the above thats occurred during the process.

 

1) A few years back I asked Lowells for a CCA - I never received the papers (genuinely) they claimed I did. A friend of a friend who is a solicitor in data protection, helped out by writing back to Lowells who then ensued a row over this - the upshot was that from the original date of the CCA to the time they actually sent the papers to my Solicitor about three months had elapsed. The papers did not include the contract. My Solicitor backed off and disinterested in helping freebees but got me that far. I then wrote to Lowells and said the account was unenforceable because they hadn't sent the contract. I have an email (all paperwork was by email) from my Solicitor confirming the Contract wasn't in the documents ..... not sure if this is evidence and look to you guys for assistance here.

 

2) Lowells (then on behalf of SAV) in one of their nastier moments wrote to my sister who was joint guardian of my mother's then bank account with myself.... this caused a major upset in the famiy as you can expect ... they said they were with in their rights to do this because it was on my records, yet

they knew precisely where I was living..... again I'm not sure whether this is evidential.

 

 

Help ... I'm drowning.... never done this before xxxx

Ok, your timeline is..

 

Date of issue 7 November + 5 days for service = 12 November + 14 days to acknowledge claim = 26 November + 14 days to submit defence = 9th December.

 

You will need to use CPR 31.14 to obtain documents that are mentioned in the claim form. I have linked you to the draft below. It needs to be sent to the Solicitor named on the claim form and you should use Recorded delivery if possible.

I suspect you will need to request copies of the agreement - default notice - Notice of Assignment - statement of account showing how the amount claimed has accrued.

 

If you are going to defend this, then you MUST acknowledge the claim by 26th November, that way you get the extra 14 days.
