    • Please go back and read my message posted at 10:27 this morning @jk2054. I didn't say that I wasn't going to provide documents, only that I will upload them to an online repo that I am in control of, and that I would share links to these. You shall still be able to read and download them no different from if they were hosted here. And, the issue I have is not so much with hosting, but using an online pdf editor to create a multi-page pdf, again I have discussed this that same message.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

If it wasn't somebody who could make a splash then the attendant would have been believed no doubt by Smart parking. It's amazing how fast these things are fixed when bad press is involved.

 

Mind you I would have thought a journalist would have known a private company can't fine you!

How I was treated on another site, is the reason I believe in this site for all to see in an open forum.

My first point to you is that it is a lot safer to discuss in an open forum.....Yes we all know that ppcs gather information from these, but a good defence is a good defence as they will see your bundle 14 days before anyway..

 

An op can read threads and decide to either pay up if they do not want the hassle..Challenge through popla, or my favourite option Go to court and show these companies for what they are....

 

What I object to is you trying to PM people offering your services as a Mckenzies Friend and you have been warned against that....Primerilly because you offer a solution that brings no evidence whatsoever and you give misguided trust to a person in a bad situation.......Then on other sites you discredit the very site you are posting on.....

 

Here is one for you, and I hope to god this goes to court............

 

I had my vehicle serviced in Halfords which cost me £350 and took 5 hours from the point of dropping off to the point of collection .....I now have a pcn stating I overstayed the maximum time allowance of 3 hours and the charge is £100

 

Is that fair ? or should I complain to the DVLA and BPA :flame:

I do beg your pardon........I have NEVER been warned of the the above! But YOU have be warned against PM people.

I only state that my personal option is the court route, and encourage others to follow suit, although I do also say there are other options such as popla.

 

Your whole attitude is very irksome and I again invite you to comment on my last post which is ongoing, however I do not require you to be my Mckenzies Friend.........Wheres Ernie by the way ?

the reality is Homebase are stuck with Smart Parking but hate them because the retail site developer employs them, not Homebase or the other shops. This is a good reason why you should copy in any correspondence with the parking companies to the retailer so they can use it as a reason for applying pressure on their landlord to end this persecution. Eventually it may get to a point that it is more trouble than it is worth to the retailers or developers to hire these greedy middlemen and make proper arrangements for managing their parking if it is really needed.

this is an open forum and is totally run as the same ,so why are you on here?????.

I think mods ought to grow a pair and sort out the members whom constantly and openly break forum rules to which we all run by.
