    • Hi I had to leave Dubai back in 2011, during the financial crisis. And only now have I received a letter from IDRWW. Is this anything to worry about about as I have 2 years left until it’s been 15 years(statute barred in Dubai). Worried as just got a mortgage 2 years ago. Could they force me in to bankruptcy? Red lots of different threads on here. And unsure what true and what isn’t.

    • Often with the Likes of Lowells/ Overdales that 'proof' doesn't stand up to scrutiny.   Think about it like a game of poker, they want to intimidate you into folding and giving up as soon as possible, and just get you to pay up and roll over, that is their business model, make you think your cards are rubbish. What they don't expect, and their business isn't set up for it, is for a defendant to find this place and to learn that they have an amazing set of cards to play. Overdales don't have an infinite number of lawyers, paralegals etc, and the time / money to spend on expensive court cases, that they are highly likely to lose, hence how hard they will try to get you to roll over.  Even to the extent of faking documents, which they need to do because the debts that they purchased were so cheap, in the first place. Nevertheless it works in most cases, most people chicken out, when they are so close to winning, and a holding defence is like slowly showing Overdales your first card, and a marker of intention that this could get tricky for them. In fact it may be,  although by no means guaranteed that it won't even go any further than that.  Even if it does, what they send you back will almost certainly have more holes than Swiss Cheese, and if with the help you receive here, you can identify those weaknesses and get the whole thing tossed in the bin.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

yes Ford, still seems slow but not like it was when I had IE as the browser

 

 

it seems pretty much as per that link i posted #109, once system ram is used up (for whatever reason) it goes into virtual ram which is slower. as you are not getting the low memory notice in general use, its prob not fatal just a 'hint' re a health check. you could try customising virtual mem as per that link eg setting a min and max. what other errors do you get?

as locutus says, 2gb is bare min re a 64 bit system.

and if you can't identify a particular program etc re memory hog/leak, then adding more ram then seems an idea. if so, try and get the same type and double it (to 4) if poss to keep the ddr?

maybe see what your tech support says, seeing as you have paid for it might as well use it?

re website use, maybe one of those addons/plugins are affecting things. disable one, try again. if still probs, disable another and try. etc

also, did you end up trying that 64bit fox? give it a go if you prefer fox, can always uninstall it.

ensure that anything installed is 64bit compatible. if not, try running the prog in 32bit mode.

It worked on Chrome on my dad's PC, seems one of the Java uploads 'eats' memory and leaves lots of 'markers' that the memory is in use when it isn't. He cleared it by disabling it (after using the fix to stop it crashing the system) then re-installed it from the Java site.

 

I think there may be a Microsoft update which fixes the Chrome problem out.

 

Have you tried a System Restore, that usually works for most problems.

am with you re java, i don't have it 'installed' in the addons in fox. also, have its auto update and run disabled (via autoruns). also use noscript.

get no other errors Ford just the memory one, for now chrome seems to be running fine, just for face book, I have to use it in ingognito but it works! lol

try disabling one by one at a time those addons you mentioned see if it affects the 'incognito'?

if I put the mask me, or do not track me on then the page does not work, have removed them and ad block so can use face book! lol I am not a fan of f/b tbh

lol if I put them on face book does not work! I will check see if there is a noscript, also just noticed I wanted to put a picture on a site I am admin on and I am not able to see them? they are there, I have to guess which one I want and hope it is right one, until it loads to the site I am not able to tell. I think either I am going mad or this comp is jinxed, it is an ASUS make

whats its spec/model number?

prob not the pc itself (apart from perhaps amount of memory), but other things eg addons, third party progs, browser setup, overall setup, etc.

seems ok, fair spec :)

have you got all those asus utilities running? which may be affecting things?

my guess is you have the on board graphics one. no probs though. eg mine (diy build) is onboard graphics with 2gb (win 7 32 bit though) with a lower single core amd processor. i have no probs, including 'standard' gaming. my allocated virtual ram is about the same as yours around 2900. but i dont have many things running.

as yours is 64 bit, unless you can id a particular memory problem program, then more system ram? i think that would make a difference?

ok Ford thanks for that, just wanted to know if it is ok to run it as it is for now? I will have a look see what I what I can remove safely see if that improves things. I do not d/l films, music etc and will see if can find the noscript

yes, is ok to continue to run imo. don't worry, is nothing fatal. you're not getting memory warnings whilst in use, just re the health check. things will slow up when it goes into virtual memory, thats normal. thing is trying to id whats causing a memory hog, trial by error. from what you have posted so far, my guess is more system ram may help?

still can not see pics, hard to explain, they are there but not there, I have to guess which one I want and click it in the hope it is right one, may just reset comp back to facotory settings or something and see what happens?

had to go back to chrome, did the script thing as suggested but nothing works and it also kept saying needed java which I already had, checked and rechecked but it was not having it! I also tried the firefox suggested to me but that was same, still not done a health check since resetting comp so will see how it runs, wish not had this one to be honest but suppose we are all lured by bargains/sales and being short of money thought it would be all right!

things still slowing up?

did you try customising the virtual memory as per previous link?

ok, download this, unzip, and run (double click) the procexp.exe when things are going slow, will be able to see what resources (memory) are being used by each service/program. look out for the third party progs. use with caution.

thanks Ford, had to use chrome but now having to restart comp a few times and each time I do it keeps saying updating and takes ages to do it

sounds like windows update, seeing as you just 'started fom scratch again'? that should settle down just now once all the updates have gone through

right done a health check and no issues! lol did increase the virtual memory, it now says Normal, 75% using,, 436 MB available, and showing amber
