      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

DO what i do. Fully tripped down windows installation. Around 4.5gb install size.

i know, was just posting up the links again for reference for anyone looking in.

:) so far so good. in the long term, could consider adding more system memory. is fairly priced at the mo, depending on the make.

only one thing now and that is to be able to see my pictures again! no matter what browser I use when I click to load on onto somewhere like f/b or GTS ( Gonetoosoon) it shows empty folders, I have to click open and hope I have chosen then one I am looking for. I looked for help re this and seems a few people have same problem.

When I first had comp I did not have this problem, so basically they are there but not there if that makes sense!

I will look into getting more system memory if things go wrong again if not able to increase the virtual memory, as mine has not got a max am unsure exactly how much I can increase it by

is it possible my graphics card has gone? asking as now when I open a page from another one the screen goes black every time and takes several seconds for it to come on, I am also having difficulty now playing games

maybe too much virtual ram? as per that link #151 '..Although increasing the paging file size can help prevent low memory problems, it can also make your programs run more slowly.'

put it back to system managed/auto, or decrease the max a bit.

presume you have run a full antivirus scan?

also, have you tried that prepaid tech support service you have?

Sounds like a driver error to me. Especially if it goes black and the GPU 'resets' itself. If a VM error caused it, usually you'd either get a lock up for a few secs, or youd get the dreaded BSOD.

Renegadeimp, it is locking up at times, no idea what BSOD is, this should not be happening with a new comp?

 

It VERY much sounds like a GPU driver issue to me. If you want help, let me know and ill walk you through removing, reseating, uninstalling, confirming a clean installation of your drivers again.

 

If none of that works, then the only things left to consider, is a dodgy interface connection, or simply a bad GPU.

 

The whole procedure should only takes 10 mins or so, but it ensures your GPU works.

If its under warranty and you live near to the shop, get them to fix it for free. It's their prob then. Not yours :)

 

If you got it direct from the manufacturer, then check if you are allowed to repair it without voiding the warranty.

Take it back to them, but be aware that they WILL try and fob you off, saying they cant do anything unless you bought their insurance. Under SOGA, they are obliged by law to sort it out.

get rid of realplayer imo, known resource hog, and not really needed much nowadays.

others seem mostly your browser, google (your browser), asus utilities, trend, and windows services (don't remove win services).

whats your motherboard model no.? assume is asus? see if that can be tweaked also via its bios?

Try this. perform a full clean boot. DO not run ANYTHING else.

 

Leave the comp running for an hour or two, then run the program that causes the lockup/crash. If it still gives you the error, then you have narrowed it down to the GPU or driver.

no worries re motherboard just a thought, maybe some motherboard settings can be tweaked, partic if using onboard graphics.

if you're ok with this, download the 1.67.1 zip (on the right (not the top header scan!), scan for viruses as a precaution (is safe imo, i use it), unzip/unpack to its own folder, open folder, double click the x64 bit one, give it a minute it will come up with some details in with tabs. post up your mainboard model number and graphics details. (can find these details via windows, but this is a catch all in one)

it does it whenever it feels like it tbh, it also now freezes and am not able to do anything with it, I am waiting for the knowhow people to get back to me but not holding my breath!. I have just tried to un install real player and it will not let me!. I am still not able to see my pictures either, it shows up blank folders yet pictures are in there

Ok. Then we've narrowed it down further.

 

It's either an overheating issue, a ram issue, or a gpu issue. You will be given the runaround with pcworld. Their insurances are crap and are used purely to generate extra money for the business. Their 'tech guys' are pretty much idiots on minimum wage who attend a 1 day workshop in how to start up a pc. If they cant figure out the problem, they normally just revert the system back to original settings using a CD, then say they have done a dozen things and it should work.

odd, realplayer is third party and uninstallable!

what settings did you do for the virtual ram? that link suggests the min as amount of system ram, and max as three times that?

there is then also the poss graphics issues eg re driver and/or amount of system ram use (if onboard).

does it cease up in safe mode?
