      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Seems we have similar interests.

I used to go to the gym 6 days a week at 50.Had a eight pack-LOL

Swim still do-In the sea-North Sea-Irish sea,wherever.

Everyday,patrol the coastline.

But heart is not what it used to be.

Due to my addiction.

I have not got Skype-but will do.

One of my friends is a top cage fighter in Britain.And America.

I would be delighted to take your advice on healthy eating and smoking.

Very kind of you.

I keep thinking about the Mediterranean diet.

But am clueless.

Maybe we will work this out together.

Let us beat these addictions.

Send them to hell where they belong.

Put them on a barbel and crush them with a sledgehammer.

Hi joshmark.

When you are next around i forgot to ask you.

What type of gambling is it.

I have noticed on the TV Football.Bingo Adverts which seem to be increasing.Then there is cards,horses,greyhounds all manner of things.

Even lottery cards and the lottery itself.

Even fruit machines.Casinos.

So many temptations for the young,all ages i suppose.

I suppose with modern technology it is easier than ever to gamble.Mobiles,computers etc.

 

Maybe this question is to personal.

You have already said you are addicted to gambling.

I suppose it is like asking me how many cigs do you smoke what brand.

Addiction says it all.

The only other thing i can add is this.

When a good friend of mine got in trouble with debt.If you get the drift.

He opened what i believe is or used to be called a parachute account.

So none of them could keep emptying the one he used.

But told nobody.

It worked for him.

Basic,no frills but handy maybe to look into.Just in case

As for the MMA,a tough sport.

Did so much training-martial arts-Taekwondo-Lau Gar Kung Fu,weight training.

I reckon it has saved my life about 3 times.

I have seen murder,all sorts of horrific things.

Better clear that statement up.I appeared for the prosecution,and he got life.

At my age i maybe can defend myself against street fighters,not professionals- the like-to old now.

Had 3 mins with a chap in the 80s who had fought for the world championship in America.

You had to pay,but a hell of a experience.Reminds me those Birmingham lads were tough,they trained and trained.

It was about the time of the British riots.I was not in the same class or anywhere near reaching that standard..

Maybe to a youngster like yourself i thought this might interest you

 

You can train hard now.As you say 6 foot 3 and built like a ox.

I am just going out for some sandbag training, but I wanted to ask you the following, as a few companies are expecting to take the money from my account on 01/08/2013 and it wont be there.

 

1 - When i write to both the payday companies and the banks - do i explain my situation and see what they suggest? Would i even explain the reason for my situation i.e gambling addiction? I am now going to GA meetings

 

Check the letters page the link for the banks.Everything is there.If you want to explain your situation.Why not.

But do not budge.Is there a advisor at GA who can back you up.Just a thought.

Only offer what you can afford.

 

2 - Or alternatively do i write them a proposal? Such as x amount per month? Though this would leave me paying for a long while - my debts are around £13k - £3k in payday loans £10k in bank loans.

 

Seems a good idea.If your income without the gambling has a good excess i suppose this is the best way to go

3 - My car has a value of around £2000 - could i end up having this taken? I do need it for work so hopefully not. I feel this may be a silly question but I have never dealt with issues such as this one before.

 

I would think unless they take you to court and get a county court judgement against you, which you then break then they may decide to ask for a baliff to seize goods..If you keep up with payments offered before it gets this far it will not arise.As Bombaymix said it is not secured against the car is it.Unsecured if not.

 

4 - I would really hate for any of these companies to end up coming to my house or anything of that nature as my mom is a very anxious person and could not know about my situation.

 

If anyone ever comes to your house.Ask them to leave.They are trespassing.When you have asked them 3 times and they do not call the police.

Do not hit them,they are only doing a job.Thinking of your size and strength.But i doubt anyone will come.Ever.

In my dealings with them,they have always left.Without any need to call them.

They do not want trouble.They only if lucky,get commission.Someone has to do it.To eat pay rent the same as us.

 

Sorry for the rather serious nature of this comment but I wanted to sort this out tommorrow! Will post a reply again when i get back in!

Where are you hiding.Or are you still sandbag training.

It is coming up to the end of the month now.

I hope you managed to open a account somewhere.Managed to sort a few things out.

Before your account gets hoovered by the creditors.

Charges will add up.Fees from the lenders etc.

 

Do not worry if you have not managed to do this.

We can work it out we have many options.

Letters,offers,budget sheets,many things.

It will work out.No matter,even if you have not managed to do anything.

 

IVAs,Bankruptcy,although you do not want to do this,because of your job.Many options.

I reckon you have pulled a muscle,that is why you have not updated yet.

I have done that a few times,you can hardly move for a day or two.

And when i had a few problems,i buried my head in the sand that much it took a week to dig me out.

And i was far from 21,in the wrong direction.

I just read your previous comment haha. I am an insurance broker actually :) But i cant progress to be a fully certified adviser until I get this all sorted out as it hogs too much of my brain!!

As for ideas on the holiday ,car insurance etc.

Get busy young man,there is insurance to be sold.

And maybe have the mother of all car boot sales.

I have heard that on facebook,there are now online local car boots,locally,that avoid commission etc

Not a member myself,but catching on fast i believe.

And local for you is one hell of a catchment area,a city.

Maybe even tell your girlfriend,i have had a few problems with my finances and am trying to sort them out.

Whether you tell her about the fading,hopefully addiction,well you may spit it out.

You know what girlfriends are like.Like mothers at times.Hopefully.

Could someone please advise the best way of dealing with,i believe the 3 Payday loans that joshmark has.

My only concern now.

It is just that there are so many horror stories.

He has a new bank account now.That hopefully they do not know about.

Will phoning the bank be enough.

Or maybe take this to them.

One a debt counselor the other has a few debt problems.

What a coincidence.

You could not write this stuff.

Could be minutes apart.

sequenci,i bet you get a lot of job satisfaction from your job.

People come in ,stressed out, anxious(that took some spelling.) and you help them out.

I bet you can see the stress and anxiety fading from their faces.

I feel a tune coming on.

A journalist came up from London via Euston-no names mentioned.But a well known journalist.

And covered the story.

Went bust,bankrupt and lost my business.Then got repossessed. In the subprime days.

A blog,really i do not understand those.Or where to start.But i do like rambling on about things.

Through help from councils.

Meeting people and sleeping on their floors.

Outside at times.A joiners yard for a while.

Bed and breakfast,hostels,even moved to the North East to find work.

One of the hostels had bars on the windows,a old police station.

Had help from the CCCS, now http://www.stepchange.org/ i believe.

And help from here with debt from members of the CAG

My mother died,my father moved south and i left home with 4.50 and a old casette,Bridge over troubled water it was called.

Here is my favourite tune from back then.

 

 

I was 17.A long time ago.Decision was,North or South.

Appropriate,but that is another story.

I hope things work out for you with your parents.

And you receive the help you need.For debt and the fading addiction.

Sorry once again i was posting as you posted.

Birmingham-passed through it about 8 times in 2011,New hall Street i think.I will check

There was a Irish Bar next to me.I will check what it was called.

OOps-seems i was on Digbeth high street.The bar may be called The Dubliner.

Where did i get New Hall Street from.Is it near.

Perhaps that is the area where i once had car troubles.

A cathedral was close by ,bells ringing,a clock tower.

I usually was there for about three hours each time.

I used to stand by the railings and watch the people cars and buses go by.

I seem to do strange things,some may feel.

One time i saw this chap coming down Digbeth High Street.

He had a look.A long white beard.Medals pinned to his jacket.

I asked him.Do you mind if i take a photo of you.

He seemed pleased.We had a chat for about 30 mins.A very interesting fellow.About 70

Been through a lot.

Looked a bit like if you remember it,Only fools and horses.Dels Uncle Albert,the navy fellow,but smarter.

Seemed a vibrant place.Busy people.

.A city,i like the feel of the place.

The short times i was there.

On my way south.

Many coincidences in this thread.

I do not think they are legally required to do this.The request.So do not hold out much hope there.

Banks and others usually take notice when sending these.Well they used to.

Sounds like they want their moneys worth

 

Charges and interest then eventually to a DCA

At least if the CPA has been cancelled the charges will not add up from your bank.Even if finishing with them.

If funds would not have been available.

Do not give your new bank account details to them.The payday lenders.

They will keep trying to empty it if you do.I feel you know that already.

It will be interesting to see what your other creditors say when receiving the 28 day request. letter.

A lot going on for you.Hope you are managing the pressure you are feeling ok.

Joshmark,have we met before my friend.

I wondered how things were going for you.

You are a bright young person,that there is no doubt of.

Minimum wage,bright prospects,yes that is true.

But the gambling addiction my friend is the root of this trouble.

You do not need telling this.

Maybe going Bankrupt in the Financial Sector is not a good idea.

If you do this,you may have to find another career.

But you are still young,if this is the final option after all others have been exhausted.

Colleges,study,uni,at your age are options as well.

And throwing those computers,the online ease of gambling is another,straight through the window.

 

What are your other hobbies,interests Joshmark.

Do you like other things away from the Financial Sector.

Personally,i know everyone is different. i did 6 months in the Civil Service,i felt trapped behind those windows.

Those walls,waiting for the tea lady with her cakes clanking around,my highlight of the day.

Perhaps you may have other interests,jobs you would consider.

Ok Joshmark,this is good news,i did not see your two posts,i was that busy writing.I am so happy you have won the battle.

In that case there are many options.

I will be around,i must get up,can not keep away from these forums,i could dance and sing,to think what you have overcome.
