    • Do not under any circumstances plead guilty until we know what we are dealing with. It's a sure way to 9 points. The tried and tested way to handle this is to plead not guilty to both charges and offer to plead guilty to speeding provided the "Fail to give information" charge is dropped. But I am concerned about this "ticket refused" sticker. I've never heard of this before. A "ticket" is not a term used in connection with speeding offences. There seems a distinct possibility that your response was received by the police but one thing worries me: I've never heard of a sticker being placed on a response and it being returned "Return to Sender". t's just not what ticket offices do. If you could post a picture of this document and the sticker it might help.  If you can show the response was received you may have a defence to the "Fail to Provide" charge (provided you completed your response properly). If the police are saying you did not respond they cannot succeed with a speeding charge (as they have no evidence you were driving). But if you did not respond, who put the sticker on the document and sent it back yo you?
    • lolerz, many thanks for your reply and correcting my big mistake, oh dear start again. They sent the section 48 along with the Form NO 6A, it was sitting on top of the paperwork, sorry about that. SO they have sent me a Form No 6A and i have received the court paperwork with the claim form and defence paperwork.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

You should know that Afghanistan was taken on by the allied forces because of the more than 3,000 innocent people killed by a Taliban terrorist attack on the World Trade Center and was ruled at that time by the Taliban terrorist organisation.

 

You should also remember that Russia invaded Afghanistan and stayed there for 9 years and lets not forget:

 

Poland

Baltic states

Hungary

Romania

Bulgaria

Austria

Korea

Czechoslovakia

 

and countless others, the aim to force Soviet style communism on them. North Korea still has it to this day and look at the state of that country.

Say what you wish but it was an army of Occupation and never sanctioned by the UN security Council. It was an american led coalition

 

Yes and the west were in Afganistan for 13 years before being evicted with their tail between there legs by farmers with AK47 made out of pots and pans

agree that he should've been deposed re GW1 under the terms of his surrender, but he wasn't. and agree that he was a tyrant.

are you saying that you think GW2 was the right thing to do?

the public reasons given for it have been shown to be incredible, but as everyone knows the public reasons often differ from the real reasons. a quick read of the un inspector reports at the time shows that there were 'certain' 'biological agents' around since #1. but, at the time of #2 they were no longer there. but there was 'some thing(s)' according to that 'curveball' :) and that seems to be mainly what they relied on! incredible!

no doubt though he could've been later deposed without the need for a 'war', and the unnecessary loss of how many lives at the time and post?

its all ironic, 'we' taught him how to be tyrannical, gas people (the brits did that there yonks ago), supported him against iran, he was then US friendly, kept the 'peace'/interests there, etc. ah the politics.

and that seems to me to be the basis of the Libya deposement and destabilisation as well. Gadaffi wanted to set up and oil backed 'gold type system' replacing the debt based dollar systems.

 

For Syria, its simply the last real Russian ally and outpost in the area. IS is blatantly just an excuse.

Syria falling would leave Iran alone and more vulnerable, hence more likely to be compliant.

 

If the mightiest military power in the world, along with 59 other countries can only bomb a path for the expansion of IS, in Iraq, Libya and Syria ...

 

when Russia/Syria hits them hard on day 1 of their strikes in Syria

and the French (based on French intelligence not US instructions) take out a training camp on day one of theirs in Syria

 

yet the yanks can only squeal - you hit some 'free Syrain army' (aka some IS supporting militant group who the yanks are supplying),

and NATO member Turkey ignores IS and bombs Kurds

and IS affiliates expand in Iraq under the US noses while 'official' Iraq moves to join Assad and Putin as their best bet- says it all really

 

 

Even 2 TORY security council members are saying we should be working with Assad to defeat IS.

 

The Yanks wouold appear to have no desire whatsever to defeat ISIS - quite the opposite it would seem.

The Russians will never allow western troops into Syria on the ground

 

The reason being is that they have interest in a major Gas pipe line running through Syria destination europe

 

Assad knows the russians will protect that so the pair of them have a sort of symbiotic relationship. Assad stays in power with russian support

 

Iran has the largest reserve of natural gas on the planet

 

This pipeline will be in direct competition to the Azerbaijan pipe line into europe

 

And you still think this is ALL about ISIS??

 

Putin is looking after his own best interests

As another security council member they are probably simply adding political weight against the US stance. Effectively 'standing' with the Russians against ISIS.

 

Hopefully the REAL fight against ISIS and its support has started.

I have no idea what reality the statements in that link refer to ford.

External intervention caused the expansion of small groups of militant activists into 'civil war' (as the west call it) in Syria.

 

In Iraq, Saddam would have remained in power without the invasion. - but no mention of that. Iraq would have fallen into civil war without it Blair says

- I thought that was effectively the state of Iraq now with the Taliban reclaiming entire areas and Iraq's western trained and equipped military running away from fights with them, and the Yanks turning again to the Kurds.
