Thanks for your reply, sadly much as I suspected with the ICO etc.

 

We received a very comprehensive breakdown of all the figures associated with the credit card going back to March 2005 which was more than useful in filling out the spreadsheet, which begs the question "if they keep that much detail why can't they keep a copy of the CCA?"

 

From your reply re paying off a lump sum to stop the overlimit charges and associated interest and ppi it seems I needen't have bothered. However I will have that discussion with HSBC if and when the need arises.

 

Similariliy if they find a copy of the agreement when the claim goes in.

Finally after sending a "put up or shut up" letter as suggested by CitizenB we have received a response to our CCA request.

Frankly it isn't worth the paper it's written on, just a blank pro forma credit card application onto which someone has copied my sons name and his address at the time he applied for the card. That's it, the rest of the form is blank.

 

Is that typical of the result from a CCA request?

You are entitled to receive the following in respect of a CCA (s78) request

 

Copy or reconstruction of the agreement.

 

Terms and conditions from both inception and at default or current.

 

Statement of account showing how the sum demanded has accrued.

 

So .. in order to satisfy the s78 request they should supply the above. This should be as one package and not in dribs and drabs.

 

However, from what you say, if the agreement was entered into prior to 2007, then they might have to provide something a little more enticing !

Just to add to what I have said before - HSBC had a period of time where they were so eager to entrap people into credit that when they opened current accounts and they saw a salary being paid into it, they sent out credit cards with the Debit cards.. there were NO agreements signed !!
