hello, i am having a few issues with section 21.

 

we were served a section 21 dated 2nd nov 2012

 

i fwas pushed under our door on the 4th nov 2012.

 

Our tenancy was due to end on 9th dec 2012 anyway and we wanted to move.

 

the s21 was not signed by anyone , they put it in my now married name and not my maiden name which is on our tenancy agreement

and they have put under agents name a company name which we have now found out was dissolved in jan 2012.

 

we were told this was not legal and so we moved out on the 5th december before our tenancy ended

which we told them as we didnt want to pay januarys rent and because we had pronblems through the tanancy

like them not fixing a bad leak and not sorting a bad mould problem.

 

Now they are asking for januarys rent still,

they also made claims of damage which we disputed

and we never had an inspection or a inventory or a proper check out

 

they have now dropped damage claims as they have no evidence

and i have photos and proof of how we left it!

 

and when i again asked about this company that doesnt exist

they now claim that it was an error on the section 21

and that this company has never had any dealings with us or our property,

 

but they have we have other letters with the same company on them,

and the trading address for that company was listed as our address,

 

we only looked into the company when it was listed as agent as were had a different agent name .

was the section 21 legal? if not was i within my rights to move out before the tenancy ended and not have to pay for jan rent ?

any advice or help appreciated.

please don't hit Quote...just type we know what we said earlier..

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

You were absolutely within your rights to move out before the last day of the fixed term - I presume you returned the keys at this point?

 

Which scheme is your deposit held in?

 

Was there an inventory when you checked in?

Precise date your tenancy commenced as per AST?

How long was fixed term?

Did you serve LL with written NTQ or any notice of intent to vacate by 9 Dec 12? When & How?

A valid s21 served on 4 Nov 12 would only expire after 4 Jan 13
