I've read through the material regarding bank charges and I have started the process off with Abbey for my personal current account but do the same pinciples apply to my business account with Barclays? I haven't really looked into it too much but I did go through a phase last year where due to bad debtors bouncing cheques on me, my account went a bit haywire. If I got charges during that period can I recoup those like I'm doing with the personal account?

you can claimback the charges on the business acc aswell

You can not rely on s.4 of the Unfair Contract Terms Act 1977, nor the Unfair Terms in Consumer Regulations as they only apply to consumer contracts. You can use the common law principles set out in Dunlop v New Garage. So you will need to ammend the particulars of claim accordingly.

Hi there,

 

Does anyone know if I can claim bck charged from a business account for the period I was the managing director going back a few years ago? The company now belongs to someone else, if anyone can find out where I stand on this I would be very grateful, thanks alot.

No.

 

The company can claim them back. You can't claim them as it wasn't your money, it was the company's money.
