Hi guys didnt know where to post this so hope someone can answer.

 

Claimant is on IS/JSA and therefore all court fees would be remitted.

 

Question, if it's allocated to multi-track, and the claimant loses

are they still liable for the other sides costs?

Although I believe that the situation maybe different if they are granted legal aid ?

yeahbut ...

 

The chances of being awarded Legal Aid for a punt on CCA and UTTC is somewhat thin. They don't like funding legal aid in these kind of cases

Another Question. If a claim (even under 5K) gets allocated to the Fasttrack/MultiTrack is there any way in which the court could order

that the costs would not be laid against a small claim?

I believe in all cases, the court has discretion over costs, but you would need strong evidence to persuede them to differ from the norm.
