    • It is already trespass, nothing further needed to make out trespass. Not sure where ‘interference with goods’ helps you / how you’d bring a claim for that that stops them parking there.
    • Thanks Dx,    For some further information, the holiday was booked as a package holiday for 2. One of the 2 had to be changed, and changing costs £700 for a new flight as "tickets had been issued and they cant do a name change". I cant quite figure out how compensation works for things when it comes to package holidays.    From what I can tell  - The plane was due to land in Turks and Caicos to drop off passengers, something happened during descent, resulting in technical fault.  - The rest of the original flight from Turks & Caicos -> Montego Bay was cancelled  - A New flight was put on today, which was then delayed by 1.5hrs aswell  - Hotel was provided for the night after much hassle.  - 1.5 days, 2 evenings of holiday lost  If I understand correctly, since the original flight (LHR -> Turks -> Montego Bay) was cancelled, they are both entitled to a refund on that full flight? I can't quite work out if they are only entitled to a refund for the equivalent of Turks -> Montego Bay, or for the full LHR->Turks->Montego Bay, since it was issued as one ticket/all Virgin, and they should have arrived yesterday..?)  I can't work out how to get the cost of that compensation, or whether its a set figure, and how the loss of days of holiday is factored in   I am aware:  If you received less than 14 days’ notice of the cancellation, you are generally due compensation, awarded in pounds or euros depending on where your flight was due to depart from, according to the following scale: £220 / €250 for all flights of 1,500km or less (e.g. Glasgow to Amsterdam); £350 / €400 for all flights between 1,500km and 3,500km (e.g. East Midlands to Marrakech); £520 / €600 for all other flights (e.g. London to New York). Compensation will be reduced by 50% if the arrival time of the replacement flight doesn’t exceed the arrival time of the original flight by: two hours for flights of 1,500km or less; three hours for flights between 1,500km and 3,500km; four hours for all other flights. So I "think" its £520pp for the flight part as compensation... but some sites say its a full refund for the flight... is it both?  Thanks,  Ryan

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi thought i would post this as to make people aware of this company and also anybody who can help with regard to stopping his activity.

I was cold called by Mr Allen Young of Pennington Pinder and Co of Sunderland (his company, not ltd) He is a debt recovery company, I had a few company debts to recover and he was not win no fee so thought I had nothing to lose. How wrong can you be. I did check the internet but only the company name, and as it was new there were not threads on it, If i had checked his name I would of been alerted to him.

He collected £3000.00 from a customer and now will not pay it over to me stating he has no money to pay me. He collected this in July this year. This person has had 2 previous companies where he has done the self same thing, if you check the what consumer forum and freeindex you will see his other companies Fraser fox and Anderson Reuters have duped customers. Can nothing be done about this. He has stolen thousands of pounds from people and nobody is doing anything about it. He does not have to be registered with the OFT as it is commercial debt and not consumer. The police will not do anything as they say it is civil and the trading standards don't really care, unless you are selling dodgy t shirts they don't seem interested. The fact that he is advertising litigation and accoutancy services and not qualified does not seem to matter, that he has letters from past customers who were never his customers on his website. I think he has been made bankrupt before, if so should he be allowed to trade not sure on the ruling on this. I have spoken to several of his old clients and they feel the same as me, he is continuing to do this and other law abiding people get ripped off. He lives in a rented house and i do no think he has any assets to warrent court action. His last company Anderson Reuters was wound up by one of his clients who he did not pay, and he has paid for this but still not got his money, which i think was about £9000

I have also reported him to watchdog and rogue traders to see if they can help at all. Just waiting a reponse. Has anybody else out there had any dealing with this crook or any ideas as what to do.

Issue a small claim then, take the sirry iriot to court, report him to trading standards and have his licence revoked, he clearly should not be the MD of any company.

BBC Watchdog, Local MP also.

Who ever heard of someone getting a job at the Jobcentre? The unemployed are sent there as penance for their sins, not to help them find work!

I had thought of going to the local papers in Sunderland to see if they wanted to do an article on him. It really is not fair everything is stacked against the people who actually work for a living, the courts are so expensive what ever you do, and he knows that as thats what he does for a crooked living.

You can issue a claim either through your local court or via the bulk centre in Northampton, but if he decides to defend the case will be heard at his local court. I'm not sure of the fees but its ~£80 http://www.compactlaw.co.uk/compactlaw-admin/court-fees.html

 

If he doesn't defend you will win by default & if he doesn't pay up there are various methods of enforcement you can then employ.

Thanks for that, what will the DTI will do? What powers do they have? If there is something they can do I will get in touch with his previous customers and tell them to make complaints against him. I am seriously considering the Echo, I was looking at that the other day actually. May as well get even if i am not gonna get my monney and try and hurt him in the pocket also.

No they don't, they had a file on him as the liquidator of Anderson Reuters contacted them. He has not even complied with the liquidator, ie not responded to any correspondence. As I found out who they were and spoke to them, that should have to lead to something should it not, you just ignore them and they go away apparently. The police won't take it up, as the cps say it is a civil matter. You live and learn don't you but sometimes the hard way, you soon realise the law is not on the side of the self employed person trying to scratch a living.

Well, they can close him down, bring prosecutions, etc. DTI are the big boys in this game, if they get involved you can be sure Trading Standards, OFT, etc will soon be on the bandwagon too. Your MP is the person to get involved though, especially if you can unearth a few other cases or get some publicity that may bring some to light. He/she can take it up directly with the DTI.
