    • Under the consumer rights act 2015, if a defect manifests itself within 30 days and you have a right to return the vehicle for a full refund. If any defect manifests itself within the first six months of ownership then you have a right to return the vehicle for a full refund subject to the retailers right to carry out a repair. If the retailer declines to repair or if the repair fails then you have the right to return. The problem here is that you have to assert their right. It's a bit ridiculous – but you have to do let them know preferably in writing that you are asserting your rights under the consumer rights act either the 30 day right or the six month right. I suppose that you haven't done this – which would be quite understandable because most people don't know that these rights exist and that they are subject to these conditions – the condition that the right must be inserted. It is frankly ridiculous. The dealers know it and we have lots of instances of this company delaying appointments et cetera and our strong suspicion is that they are simply trying to run their customers out of time. On the basis that you haven't asserted your rights, we now have to look to ordinary contract law. You are entitled to purchase a vehicle which is of satisfactory condition and which remains that way for a reasonable period of time. Clearly it is in satisfactory. They are blaming you. Has your independent inspection identified the reason for the defect? This will be important because as you have seen BMW are already saying it is down to your driving and you are going to have to produce evidence that it wasn't down to your driving and the you drove it absolutely reasonably and it was simply the condition of the car. Have you been without the car for any period of time. Is it driveable now? If the car was off the road for a substantial amount of time and was still off the road then you would be able to argue that this is a fundamental breach of contract and that you have been deprived of substantially the whole benefit of the contract and therefore you will be entitled to treat the contract as breached by Big Motoring World and insist on cancelling the contract. It may be that you will eventually be obliged to keep the car but have the repairs paid for. Have you had any quotations for the work that needs doing? I asked you questions about the MOT – but you haven't responded.

    • According to Parkopedia parking is limited to two hours.  I don't know how accurate this is though. What were you doing there for four hours?

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

cheers paul,they've been playing silly buggers with us so we may as well try to make it as painful as possible for them.just a thought ,it may be that they have seen the growing trend of people claiming contractual interest and decided that dla's dragging of feet has backfired enormously on them.hope so anyway.

Well the final hurdle has approached and I have managed to clear it at the first attempt.

 

Court bundles have been issued to DLA Piper and the Courts, (they are due by Tues) anyone wanna bet that Abbey DON'T issue one??? (Come on someone must want to take the Bet?) So now i'm in the final furlong of the home straight and I can see the winning line.

 

The only thing left is Abbey to Fold, clear my credit record, and pay me whats mine at the contractual rate :)

Well what a surprise no Court Bundle or contact from Abbey or their Solicitors still. Went into the Branch today and Abbey have added even more interest and charges to my account :(

 

They have also paid a cheque into my account, but guess what?? The cheque also covers (repays Abbey) some of the new charges that they have added and that I didn't know about, ummmmm what shall I do? (I Know i'll sue them.....lol)

 

Also they have still left me with an overdrawn balance due to the new charges, lol (Can you believe the gall of them) now waiting for Debt Management to call and ask me to repay the rest of the overdraft off......ummmmm NO!

 

Still no movement on the default / Status markers removal and I consider this a BIG part of my claim so I am continuing until this is sorted, hopefully then this will end in court and I can request the contractual interest, (need to work out a new figure now to take account of the payment received.

 

So I guess that it's time for another letter, thanking them for the partial payment and reminding them of the court date.

 

I am still waiting for the second cheque (due to be posted today for the balance of the original claim) previous to the new charges they have added.

 

So now I am fuming even more due to what they have done.

 

So in short - This is NOT over yet. Round 2 begins shortly (for the new charges) Then we will start round three (although I may merge round 2 and 3) for pre 2000 charges and the data that was missing during this claim.

Spoke to court today (18th Oct), Abbey HAVE NOT submitted a court Bundle, (theres a surprise), But they may have submitted a statement will need to check tomorrow to find out what the statement says?

 

I think it will say something like.....

 

Jannercobbler has now been paid, (Untrue, Received Partial payment and still not cleared, still awaiting the rest IN CLEARED FUNDS).

 

nothing heard from Abbey so still continuing, only 12 days to go :)

OK lastest update is I have today received a copy of Abbey's defence (if thats what you want to call it) The court case is on Tues (yes next tues the 31st at 2.30pm in Plymouth for those that wish to come ;)) I intend to carry this through to the end unless they do something amazing by then.

Paul, if you don`t take this all the way to the court, follow my post when I file my N1 on Tuesday (I`m taking No Prisoners), as I won`t be entering into any dialog with Shabby after I`ve filed (gave Them MY offer of settlement in my last letter, with no turning back if they refuse) and will let the court decide the outcome.

Well I have just had a phone call from the Court, Todays appearance in Court has been cancelled BY the Judge, - Reason he doesn't think 2hrs are enough, and also as I sent him a letter saying I had not received anything from Abbey, as there defence. (Did explain that I was ready anyway)

 

Therefore I will have to wait a bit longer, but on the positive side it adds more interest.

God, this has me on tenterhooks, so let me get this right, how much of the claim have they paid? and how much is owing (apart from the new charges which Ipresume will be the basis of a new claim, much like me) and you are wanting the removal of defaults? and the judge doesnt think that 2 hours are enough, are shAbbey actually going to product the goods? nahh I dont think so, expect full settlement and defaults removed very soon Paul

Paul,

As you know, I`m filing this week in court for charges and Default removal (got my papers ready) and was hoping to get a stear from this.

It`s a bit confusing, as the judge originally set the time required, seems a bit strange that he should change his view at this late hour.

Perhaps he too did not receive a defence from Abbey, and perhaps after the court contacted them, they have received direction to resolve the issue or face being charged with contempt of court.

Either way, I`m sure that Abbey will settle with you soon (Very Soon!!)

The court had Abbeys defence, I sent a letter to the Judge letting them know that I hadn't received a copy, but I think the letter I sent and the size of my court bundle made the judge think that 2hrs isn't enough, new letter to Abbey will be sent letting them know i'm still pursuing the default removal and the amendment to CI, and the interest is still accumulating, even though they have paid me some, that is only a part payment.

If the judge got a shock by the size of your court bundle, imagine how the Abbey must have felt, they must have cacked their pants! and then to follow that up with a call from the court telling them the judge feels that 2 hours is not long enough for the hearing, they must have gone searching for the nearest vacant loo.

I now have THREE copies of Abbey's defence (2 from Abbey and 1 from the court??), I now also have the Judges order, Abbey have to give a time estimate, as due to the size of the Bundle 2hrs may not be enough, and they have to file and serve a skeleton arguement 5 days prior to the hearing (therefore I should know what there reasons are and can counter it, or they roll over and pay and remove :)). although there is no new date yet?

well done mate, I'm watching this with great interest.

I currently have a claim outstanding with Nationwide and in my POC I gave the judge 3 options like yourself a. unauthorised interest b. authorised interest and c. S69 8%.

Nationwide have chosen to pay me option b. which I've accepted as partial payment and i'm going after the rest - LOL when one of their staff told me I wasn't 'entitled' to the rest so I've since sent them a letter along the lines of "I think its up to the judge to decide what I'm entitled to - see you in court"
