    • Thank you for posting up the results from the sar. The PCN is not compliant with the Protection of Freedoms Act 2012 Schedule 4. Under Section 9 [2][a] they are supposed to specify the parking time. the photographs show your car in motion both entering and leaving the car park thus not parking. If you have to do a Witness Statement later should they finally take you to Court you will have to continue to state that even though you stayed there for several hours in a small car park and the difference between the ANPR times and the actual parking period may only be a matter of a few minutes  nevertheless the CEL have failed to comply with the Act by failing to specify the parking period. However it looks as if your appeal revealed you were the driver the deficient PCN will not help you as the driver. I suspect that it may have been an appeal from the pub that meant that CEL offered you partly a way out  by allowing you to claim you had made an error in registering your vehicle reg. number . This enabled them to reduce the charge to £20 despite them acknowledging that you hadn't registered at all. We have not seen the signs in the car park yet so we do not what is said on them and all the signs say the same thing. It would be unusual for a pub to have  a Permit Holders Only sign which may discourage casual motorists from stopping there. But if that is the sign then as it prohibits any one who doesn't have a permit, then it cannot form a contract with motorists though it may depend on how the signs are worded.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

brilliant thankyou so much, trying to sort out wonga and payday express at moment, wife is seriously ill and we only now have one income, so need to do repayment plans with them, fingers crossed! have secured my wages to go into wifes account so am in process of drafting emails to send to them in next few days,have also told bank to stop payments etc, payments are due out in next 5 days or so. any help with the email and what it should contain most welcome!

Offer them what you can afford to pay, even if its only 1£ per week or so, while they are not legally required to just accept any payment payment plan ultimately they don't have much choice, after all it is better for them to get the money back slowly than not getting it at all.

 

Also make sure you don't agree to pay any of their ridiculous charges, all you have to pay is original loan + 1 month interest - any payment already made.

Get in touch with the OFT, send that harassment letter out, and also get in touch with Stella Creasy MP. Wonga have been in the media a lot lately due to OFt investigations and a LOT of complaints about their business practices. Calling you at work is a very big no under the eyes of the OFT.

no they havnt as yet, im just getting everything ready in case, as im at the hospital alot seeing my wife, i want to make this as easy as possible so she doesnt have any worries, and if im armed with everything i can just send out asap! any advice as to what the email should contain with regards asking for a repayment plan? are they ok ish to deal with? wonga and paydaye express? thank you, you are all brilliant in helping.

Wonga are pretty decent with repayment plans. Just make sure you get it in writing before you send any money. PDE it's 50/50 with them.

hi, after sending 8 emails on a daily basis have had this reply from pde,

 

Thank you for your recent contact and your request for a repayment plan.

Our accepted criteria for a repayment plan are as follows:

 

• Significant Loss of income

• Unexpected change in personal circumstance, e.g. Long term sickness

• Severe Disability or illness (including close family members)

• Terminal illness or Mental illness (including close family members)

• Deceased (including close family members)

• Redundancy or Reduced hours (contractual hours reduced by company)

 

All or any of the above may require documented evidence. I.e.:

 

• If you are now unemployed or in receipt of financial support, please provide proof of unemployment or redundancy. If your contractual hours have been reduced by your employer, please provide a letter from your employer on company headed paper to confirm this.

• If your circumstances have changed due to personal illness, please provide a copy of a doctor’s note or hospital letter.

 

If your financial circumstances have changed we may be prepared to consider a reasonable and affordable repayment plan.

 

A repayment plan does not vary or release you from the terms and conditions of the signed loan agreement, so if you fail to comply with the terms of repayment plan we have the right to obtain payment of the full amount outstanding together with accrued interest and charges from any of the debit cards that you have supplied to us.

 

At 90 days past the original due date whether an agreed repayment plan is in existence or not we will register a default on your records with credit reference agencies.

 

my wife is seriously ill, so how much info do i give them, what do i actually give them? do i actually give them proof? is this just a standard letter sent to all? help most welcome.

Ignore that letter. It is NOT up to them what qualifies as hardship.

 

If you cant meet the repayments, and have an I&E as proof, then its tough luck to them. If you have PDE's bank details, you can set up a standing order directly and use your account number as a reference. They are then obliged by law to accept it and credit it to your account. It also covers your back in any future action or arguments.

thank you for that, i havnt given them an i & e as yet, do i def need to do this? no dont have the bank details but will see if i can get them, i have read on other posts, that all i should pay back is one months interest, is that right? i do intend to pay it back just need time and with my wife so seriously ill its hard at the moment, is emailing the way to do this? i will not be ringing them.

You dont have to, but its a good idea so you can cover your back. However, dont give them a full I&E. Just a summary is fine.

 

Also remember that they are low priority creditors, and you are in a difficult situation. Under the terms of their credit licence and OFT guidance on debt collection, they MUST take your situation into account.

hi i emailed again pde with the advice above, and had the exact email back which is also above on this thread, completely yet again ignored request for payment plan, gave a very basic i & e, i dont see why i should them a doctors letter about my wife, this is distressing enough without having to go into details with them, any info on next email to send please?? many thanks

 

 

also dealing with wonga at same time, sent 10 emails but no repayment plan, keep asking me to call them which i will not do, any further info on dealing with wonga please?? its like they are delibertely taking their time so they can add more charges etc?? i am right in saying that i should only pay back (eventually) the amount i owed plus one months interest??

PDE are taking the mick now. Write a formal letter of complaint to them, and get in touch with the OFT. Pladce the account into dispute until they accept your repayment plan. If you need help with a letter, let me know. I have a good one you can adapt that pretty much forces them to accept. If they refuse, then they are in trouble.

hi renegadeimp,regarding pde, thank you if i could have the letter you mentioned it would be most welcome, dont know how much more i can take, im trying to spend as much time at the hospital with my wife as i can and deal with all this as well, they are still insisting i provide proof, im still getting my wages at moment but no income at all for my wife as yet, so cannot use my wages to pay them in full else we have no money for rent etc, i have blocked them on my mobile (although it still tells me how many texts or calls theyve tried to make to me, 17 yesterday,) and have told them i will not call them, written correspondence only.

 

also wonga are being absolute pain as well (these are the only 2 i have) they sent this yesterday,

 

"there is no proof or DOCUMENTS attached to show REASON for hardship.

 

 

REDUCTION IN SALARY- Salary Reciept2-3 salary receipts

 

P45 if currently unemployed /

 

or proof of benefits

 

JSA documents"

If you can't afford more than £30 a month don't offer more than £30 a month, however what you can do is to say for example you offer them £30 each month for three month, then re-evaluate the repayment plan, that way they might accept it.

PDL companies are low priority creditors, so personally I'd offer what you can pay and then stuff them if they whine about it. At the end of the day, you can only pay what you can pay, it's not like you can magic money out of thin air.

 

They don't need any proof of documents. And they certainly aren't entitled to them (they can ask for them, that's their right, but that's about it). But hang on in, there are far more knowledgeable people on here than me that can offer all the help you'll need to deal with them :)

have so far sent over 12 emails to PDE and Wonga and still no help whatsover

hi yesterday i had from PDE 17 missed calls and 5 sms's,still no acceptance of the payment plan i have offered, if renegadeimp is able could he send me the letter that he was suggesting on one of the threads above please, my wife is so seriously ill and im at the hospital alot but really need to sort this out, they are still wanting proof of why i cant pay, and im NOT sending them proof of my wifes illness and her loss of income.
