Hi all, I'm in a bit of a mess. I came into trouble with numerous payday loans, which came to a head in March and thought I had paid them all off. How wrong I was. Since the start of July I have been receiveing text messages and emails and phonecalls from Marshall Hoare Bailiffs. Demanding an unreasonable amount of money. The loan was for Speedcredit, and I never heard a thing from them demanding money untill these fools got involved.

Today I got a voicemail from a lady claiming to represent Marshall Hoare, saying I had to contact them urgently or I would get a home visit to collect goods to the value of the debt. I have had 7 text messages since the 30th July which say:

 

Home visit within 7 days.Speed Credit £865 file is now owned by MH Bailiffs.Check email & call 0843381111 to settle your debt & avoid extra charges

 

The amount has gone from £841 to £865. I no longer live at that address as I have relocated and currently unemployed so have no way of paying this amount off. The original loans was for £200. I've had numerous emails which are all the same, just an extension on the text message really. But I received this email today:

 

Loan ref xxxxxxx

 

Dear Miss xxxxxxxx

 

Please explain in detail why the loan was taken if it could not be repaid in full as per the terms and conditions you agreed to?

 

Please note that we would like to come to an amicable arrangement with you but any offer that is too low will lead to your file incurring fees and being passed on to third party Recovery Agents and Solicitors. Your national credit file will also suffer affecting your ability to borrow in the future.

 

Please explain in detail with evidence exactly what has changed in your circumstances since you took the loan.

 

Please note that to freeze the file now and to stop any further action on it you will need to:

 

CLEAR the balance within 4 weeks from today

 

the first payment being made within the next 5 working days.

 

Thus you will owe a frozen balance of COMPLETE

 

Please confirm your commitment to this arrangement and confirm what payments you will be making and when.

 

If you cannot come to an arrangement such as this your file will be passed on to third party Recovery Agents and Solicitors and fees will be incurred. Your Credit file will suffer and you will be pursued independently of ourselves.

 

We look forward to hearing from you today so as to achieve a speedy and cost effective resolution to this matter. If we do not hear from you today your file will be passed on.

I'm guessing she is the one who left a voicemail. Now every email, text and phone all I've had have been forwarded to OFT for complaint. They must be getting sick of me now lol. I know they have no right as Bailiffs as they have to be court appointed to demand money on your doorstep.

 

But I'm at a loss at what to do now. I don't seem to be able to find a valid address for this company to make a complaint to them, and also ask for a listing of all the extra charges. The emails I send just bounce back. Has anyone here had any dealings with these guys? What can I do? And do they come to the property? (I'm not there but my parents are) any help or advice would be appreciated.

Ok. First, never deal with these con artists by phone. 2nd, make sure you get a full complaint into the OFT and trading standards. SImply pretending to be bailiffs in an attempt to scare you into paying them is enough to cost them their licence.

 

As for emails etc, you are correct. They do bounce back. It's one of their tactics to avoid a paper trail. They say contact is only by phone as they are a "paperless office". This in itself is a breach of law.

 

Your Credit file will suffer and you will be pursued independently of ourselves.

 

Very weird wording, since a debt can only be pursued by one company at a time.

Well I have sent several emails to OFT each time I get a text/email or voicemail from Marshall Hoare, and they have replied saying they are investigating but can't comment on individual cases. Is there anyone in particular I can contact on trading standards? Or just send a complaint to the contact address on their website?

Do you have an address I can start sending letters o Marshall Hoare Bailiffs? I am not saying I don't owe the debt, but there is no way I am paying what they are asking.

Got this text today too:

 

Your file is INCURRING INTEREST and is harming your credit file. It will be passed to Recovery Agentsif we do not hear from you TODAY. CALL 08433811111.

 

Any merit to this text? Or merely a tactic to try and scare me? They have been saying for weeks now "home visit within 7 days" but haven't had this message before.

Contact trading standards and tell them wht they are doing. Let them know.that there is no way to communicate by post and any letters to their registered address at companies house goes unanswered and the harassment/ threats continue.

Okay many thanks :) Just want to get them off my back really, if speedcredit had got in contact when the loan was first overdue, I wouldn't have had a problem in paying. They seem to have left it deliberately so all these charges can be added.

If I send a letter to speedcredit will that have any effect at all? I will deffo be contacting trading standards.

What do you think about the text I've received today?

Speedcredit normally ignore all communication unless its an official one, from a solicitor etc. If it gets passed to NDR, they are usually more relaxed, although they still threaten and intimidate almost as much as SC do.

Okay. Well I've heard nothing from speedcredit regarding this loan, although I can log in to view how much I now owe £865 yay!! Lol

So what would your advise be? Just sit tight, keep complaining and ignore Marshall Hoare?

Yep. I'm currently helping out another poster who has pretty much the same issue you have. I have a good letter written up for him/her, im just waiting for them to respond to their thread.

 

Onc ei post it up, feel free to edit it to suit your needs as well.

The letter was written specifically for the poster there, but you can get an idea of what you need to say. Just dont rewrite it word for word, as when they start getting an idea that it could be a template letter, they normally ignore it.

SC Or MH. Both the same group of companies, so send it to the one who is currently sending you threats. If both are sending you threats together, then state it in the letter that it is against OFT guidelines for multiple collection agencies to try to collect on a debt at the same time.

Received this message today via text

 

You REFUSE TO SPEAK to us. Call 08433811111 TODAY or recovery agents will VISIT ALL ADDRESSES and a Bailiff company will pursue this debt.

 

Funny as I thought Marshall Hoare were a bailiff company, so why send another bailiff company out? Really don't like these people :/

Ignore it. That proves they are delibrately ignoring your efforts to pay them back whoch is in direct violation of the terms of their credit licence.
