Hiya

Managed to pay off all my payday loan debts, well thought I had. Just had a txt 2 days ago:

 

You REFUSE TO COME TO AN AGREEMENT WITH US. CALL 08433811111 TODAY or your file will be passed to RECOVERY AGENTS for pursuit.

 

I'm panicking now. I'm almost 100% sure I have paid everything. I have sent them a question asking what this debt is. I have moved addresses, new life So now I'm panicking my parents will get a visit? I have had no contact from anyone regarding any debt since I paid everything off in March of this year. So I can't understand how I've

"refused to come to an agreement"

 

I had a voicemail from a man yesterday telling me to contact them urgently, sounded pretty threatening to be honest :/

I sent them a email thing through their website telling them I would only contact them through email or letter, not telephone. Within 10seconds, yes 10 seconds I got this reply:

I don't have a debt management advisor!! I have no idea what to do now.

 

I have made a complaint to the OFT. And i have put this up in the payday loan forum too, but thought someone might have dealt with these people in this forum.

Any help or advice would be appreciated

Have they already obtained a CCJ? If not they are acting as debt collectors, and are powerless, they most certainly cannot remove goods, or enter your home. they can be as irritating as a boil on the bum; however as you have mentioned OFT would be an option if they act in an unlawful manner.

 

How much was the debt, and what are they asking for now?

We could do with some help from you.

Not that I'm aware of, as I said, the above is the only communication I've had at all. From what I've been told these people are under investigation by OFT anyway for their behaviour. I do not know what the original amount was for as they won't let me know, and the company I had the loan from (speedcredit) will not get in touch with me. But the amount now owing is £817 and there is no way I can afford that :/

You've done the right thing by contacting the OFT and it's good to hear they're on the case. You need to go back to Speedcredit and ask them to confirm, in writing, that you have paid all sums owing to them within 10 calendar days of their receipt of your letter, which you should send by Recorded Delivery. If they confirm you have paid all sums due, go back to the OFT and inform them you have evidence that you have paid all sums owing. It is likely you will be told to report to your local Trading Standards Department. It is also possible you may have to make a statement to the police. Making unwarranted demands by use of menaces (threats) where the person making the demands has no right in law to do so and the threats are not a proper means of enforcing the demands is a criminal offence under Section 21, Theft Act 1968 (Blackmail). This offence carries a maximum penalty, on conviction, of 14 years' imprisonment. It is one of the more serious offences under English Criminal Law. Depending on the gravity of the offence, the average sentence for those engaging in Blackmail is 4-6 years' imprisonment, with more serious offences averaging 6-8 years' imprisonment.
