Hi all,

 

Stupidly in 2010 I took out a loan for approx £100 with the above. I eventually got a CCJ through non payment. Long divorce and lots of debt later, it turns out although I set up a repayment plan I only made one payment on it. 2 years have passed and urgent loan needed I applied with them again not realising. Anyway....they have emptied my account in 5 debit card transaction

s(different one than linked to old debt)

I intend paying them but do they have then right without notifying me?

Total amount was £283. The initial agreement was for £50 a month. They have taken £125 in 5 transactions. I sent an email and received this back. I have never logged in to do such a thing.

Regarding how we collected the monies owed, please be advised that our audit trail clearly shows your log in activity to your existing account, providing us with your new card details to take payment on your existing pay day loan account presently held with ourselves. We need to make you aware that our next course of action may be to apply to an attachment of earnings which will be taken directly through your employment and increase your balance by a further £100.00.

You should ask them for unequivocal proof that YOU logged into the account and made the transactions.

 

Also, didnt you go and defend the CCJ case? As for the extra £100 i wonder where they pull their amounts from. Because it isnt reality.

Before the CCJ happened, you would have recieved court documents around a month beforehand, plus a letter from the creditor stating that they are taking you to court.

 

Go to your bank and get a full chargeback on the amounts. Then contact the court and see what they say in view of repayments. Hopefully someone here can step in and advise on the legal side of this, as im admittedly not that knowledgeable about it.

Name and shame your bank. They have no right to tell you that.

I bet you spoke to the frontline reps didnt you. If you escalated it to a manager, youd have more luck. It is YOUR money. However, i'm thinking a CPA was active and the PDL exploited it and used it to debit your account multiple times. If you are on SMP, then the bank should refund it immediately as its money to live on. Not to pay bills. Call and speak to a manager. If they refuse, file a formal complaint with the bank and FOS.

 

If the transaction was made with a visa card, then tell them to refund it. By their own rules, they refund/chargeback first, then investigate later.

Just remember, these are all private companies, so they will try and do anything not to give you their money back. Even when they are wrong, they try and say its " a gesture of goodwill"
