Right, have now completed the charges spreadsheet (charges now total £1,760! I really am in shock)

 

Have just printed off my letter so....wish me luck!

Yep, I sent it to the same address - it's the HSBC head office in Canada Square. I also sent it recorded just to be sure it arrived safely - I thought that would be the prudent thing to do since it could be worth £1616!

Hi there, I have sent my letter off today (charges = £2901 !) So I will keep you updated on how I get on. I sent mine recorded to the Canada Square address just to be sure. Keep us updated as to how you get on! Here's hoping for a lovely christmas prezzie!

Could someone answer a quick question for me please?

 

I've been reading through a few more posts today and now I'm worried! I sent off my prelim letter a week ago but, for the main, just used 'Total Charges' on my spreadsheet. Is this wrong? Should I have tried to break them down into exceeding overdraft etc?

Using 'Total Charges' is fine - as long as they're dated so that the bank can reference them if required.

'Total Charges' are different to other charges, and can be claimed for as well. Make sure you're not missing out on other charges, as 'Total Charges' are not the same thing as those others!

I'm pretty sure I haven't missed any (!) Mine seem to consist of returned DDs (£30) and then a Total Charge every month of £27.50 so this is how I've recorded them on the spreadsheet.

 

6 days and counting to LBA! :D

You seem to be at the same stage-ish as me. My LBA is being sent out on Thursday, if nothing heard. (It would be novel if I heard anything by the sounds of others' experiences!) I'm also amending my claim to include contractual compounded interest with the appropriate textual insertion explaining the amendment.

 

If you use mindzai's spreadsheet (from his signature) it calculates compounded interest once you input your own contractual interest. (15.9% or so for HSBC both auth and unauth od.)

 

If you use contractual interest, then the "fun" as folk say starts earlier, and a claim of £1011 becomes nearer £1900!

Ooh, bit of an update. Filed my MCOL 2 days ago (which has been acknowledged today) but this morning received a letter from Colin Langdale offering me £1,479 (am claiming £1,740 + 8% interest now)

 

Just a couple of questions:

 

1) As I've already filed my MCOL do I just ignore this letter? I have no intention of accepting his offer, am prepared to go to court if needed.

 

2) In his letter he says, "If your claim for a refund proceeded to Court, we therefore believe we would successfully resist any legal challenge in relation to these fees." Is this just him trying to intimidate me or is he being serious?

 

Was stupidly excited to receive the letter though, thought they were just ignoring me! :D

Just a quick update: HSBC filed the standard defence on Friday (3 days before I would have won by default :mad:) and I recevied a letter from DG on Saturday asking for a breakdown.

 

I'm just compiling a letter to them now to post off tomorrow enclosing a breakdown of my charges and reminding them that I have to file my AQ by 26th December so they'd better get a move on!

 

Just a quick question though - do I have to add into my letter the fact that they also owe me my £120 MCOL charge or does this go onto my breakdown?

you are sending a cover letter with the breakdown so just put:

please note I will now require xxxx.xx for charges and interest as per my claim plus £120 for court costs making a total of: xxxx.xx. Upon receipt of this amount, I will halt my claim with the court.

you can put it on the breakdown if you like but they know what's up - put it in the letter and try to be firm but polite in your dealings with them.

still send it recorded. they seem to be doing a lot of this lately - where before you could count on an offer in the third week of the 28 days - now, i've read several where they don't even ask for a breakdown before the defense is filed. but, take heart, we are still seeing them settled before the aq has to be in in most cases. send your breakdown tomorrow and i'd say thurs or frid. call on the pretext of asking if they have received your breakdown. as the courts will obviously be closed 25 and 26, i think you need to check with the court to see if it needs to be in by the friday, the22 by close of office and that may even be earlier than normal - best check by calling the cust. serv. number on the mcol site and then tell dg in your letter - that due to the holidays you will need to file your aq, no later than thurs. 21st. fingers crossed for you. get that breakdown off asap.
