    • Thank you for posting up the results from the sar. The PCN is not compliant with the Protection of Freedoms Act 2012 Schedule 4. Under Section 9 [2][a] they are supposed to specify the parking time. the photographs show your car in motion both entering and leaving the car park thus not parking. If you have to do a Witness Statement later should they finally take you to Court you will have to continue to state that even though you stayed there for several hours in a small car park and the difference between the ANPR times and the actual parking period may only be a matter of a few minutes  nevertheless the CEL have failed to comply with the Act by failing to specify the parking period. However it looks as if your appeal revealed you were the driver the deficient PCN will not help you as the driver. I suspect that it may have been an appeal from the pub that meant that CEL offered you partly a way out  by allowing you to claim you had made an error in registering your vehicle reg. number . This enabled them to reduce the charge to £20 despite them acknowledging that you hadn't registered at all. We have not seen the signs in the car park yet so we do not what is said on them and all the signs say the same thing. It would be unusual for a pub to have  a Permit Holders Only sign which may discourage casual motorists from stopping there. But if that is the sign then as it prohibits any one who doesn't have a permit, then it cannot form a contract with motorists though it may depend on how the signs are worded.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

looks like we all (hopefully) had a peaceful weekend which is good :-), so sorry to break the silence -

 

i responded to the e-mail joseph sent me and basically just said ' i urge you to look over my complaint again and take time to reply and that im looking forward to hearing from you before the 8 week period is up'...

 

For the more experienced users on this forum, i would just like to refer to part of the e-mail he sent to me, which i read over again and has left me slightly confused:

 

Web Loans Processing handle a number of products and are clients are able to view their details on affiliated websites. This is to ensure that they are able to make payments in the case of one website not working. It is impossible for anyone to get into your account without your personal details being entered and your data is fully secure. There has been no data protection breach.

 

what is to be made of this? Is it basically a confession that speed credit and toothfairy, ndr and mhb are all and one?

Hello one and all, have received an SMS from legal dept stating if i do not pay today they will load the loan with another £350, have emailed Joseph and forwarded to OFT and FOS, i remember seeing a post somewhere about putting ablock on any payment to them via my Bank, can anyone advise the process i would need to follow. I hope you are all well

You need to write a letter saying your cancelling the continous payment authority for speed credit/ndr/marshall hoares/toothfairy , you do not give authority for these companys to take.any amounts frim your account and wish any attempts by them to be blocked. Take it into the bank and ask for a reciept to say the banks recieved it

Same old crap from this bunch of clowns, i now have another bank account to ringfence our wages, that was the best thing to do, just thinking if NDR took payment so would Speed credit so moving your bank account was the best option

the usual dribble - note how NDR said they were going to attempt to take money from your account, yet speed credit reply to you saying payment has been declined and to pay through the NDR website (yet more proof they are one and all) - OFT and FOS time!

The bank details of Marshall Hoares and the bank details of Paycheck Credit are the same - probably the same as Speed Credit also.

 

I am sure the regulating bodies all know already that SPEED CREDIT/NDR/TOOTHFAIRY/PAYCHECK CREDIT/MARSHALL HOARES are one and the same.

 

Anyone with google and a little bit of knowledge can establish this beyond doubt.

 

Lets hope they are actually doing something about it - the tragic thing is that many are INTIMIDATED and have a life of misery trying to pay crazy charges and interest any loan shark would be proud of.

 

Panorama should investigate this lot - something might at last get done!!

After the 14-28 day period, you are technically in breach of contract therefore it is possible for the company to take action to recoup its losses due to your default. No contradiction. Your assumptions regarding the charges and the charge backs you made are incorrect. These payments were made in accordance with the contract you signed and breached.

If you had made arrangements at any point to repay your loan, your account would not be debited under the continuous payment authority you provided. Unfortunately, as you appear unwilling to acknowledge the full extent of your liability this has not happened. You have had numerous opportunity to do so but persist in your intransigence.

Wow - this man is just plain ignorant and can't even answer any questions I have for him and decided to turn it round on me. I am simply offering to repay what i owe am i not?! I'm now going to offer him a monthly payment of £1 by depositing into their account :lol: and say that I this is going to continue until the full £354 is paid off even if it takes 354 months, and then try and take me to court, because unlike you Joseph, I have filled in all the gaps - you have left unanswered questions, so should you ever take me to court, I will be laughing!

I'm now going to offer him a monthly payment of £1 by depositing into their account :lol: and say that I this is going to continue until the full £354 is paid off even if it takes 354 months, and then try and take me to court, because unlike you Joseph, I have filled in all the gaps - you have left unanswered questions, so should you ever take me to court, I will be laughing!

 

 

I find it unbelievable that he has the nerve to call you stubborn for questioning the charges the company add and.refusing to pay them, yet he refuses to justify them, hes one ignorant man

I know - it is a liberty! I'm going to e-mail him back later today and say that I'm only going to pay the £354 - £1 a month and if he don't like it tough cookies, because I've tried to reason with him, and he is still hiding behind all the secrets, lies and deciet, and still thinks he can get away hiding all the issues that numerous people are having and pretening that being a legal loan shark is ok, when it is wrong on many grounds! Not to mention another e-mail to the OFT and FOS just to let them know that Joseph is not at all helpful and it's like speaking to a stubborn brick wall!

I.sent him a email asking why he wont provide me with a notice of assignment for marshall hoares and asked why hes telling me to pay directly to speed.credit when according to mh.they legally own it. He just seems.to be ignoring me again, i find him a rather cheeky.man.as he told.me i was gettin sidetracked.by.asking for the info.i required

LOL - what a clown! He's the one getting side tracked not admitting to the awful, threatening and unprofessional service his lot provide... I have challenged him about every e-mail and text message I've ever got from them and asked him to justify why he's accussed me of fraud and why would you threaten to call the police, send bailiffs and solicitors if you cant even follow the correct procedures... Funily enough, same reply: I'm the bad guy! Still keeps ya thinking...

Hi all, well its monday had an email from MH stating they will be attending my home addresss. And more fees added, they state i have nit replied to letters nor email. Well they have not replied to my repayment plan. Has anyine had a visit from MH. They state they now are applying to the court etc etc . Due to make a payment as per my requested plan in wed this week should i make the payment via cash transfer direct to speed credut bank account. ????

rippedoff15 - in the 14 months they have threatend to come to my house, call the police, take this to court and take goods up to 9 times the value of my debt (haha this still makes me laugh), all i have had is threatening phonecalls, e-mails and 1 letter (the letter came right at the beggining)! If they come you are well within your rights to tell them to take a running jump, as they are NOT bailiffs!

 

I am about to write back to joseph xxxxxxx (one of the masterminds behind this mess), have u got in touch with the FOS?

Well just had an email from MH aka Adam Franks stating i must call them to arrange a payment plan to clear the amount 883.00. Clearly they are in cookoo land. Who is adam franks he states he is the door collector ! Nice hobby collecting doors lol

its a 'stage name' possibly an Alias - i would place a small fortune of a bet on that if you called and asked for 'Adam Franks' he would not exist and i am certain that whoever wrote that e-mail is not called Adam Franks! Marshall Hoares won't do payment plans less than £150 a month. If one of their directors can't even legally justify the extra £2000 i have apprently accrued in charges - then it just goes to show that they are trying to profit themselves... What a bunch of cowboys!
