    • I had to call an ambulance for my wife, but one of the paramedics was not happy, about the condition of our house, as it's cluttered. And he  would only see to my wife, on the ambulance itself. After diagnosis they took my wife to hospital. My wife was ill for a few months, and received help from the district nurses. We then got a call from a social worker, who wanted to visit us, and discuss ways to make my wife more comfortable. When I asked for more details, she became vague, but could give us a phone number, if she visited. I politely declined her offer, as I was coping, along with my daughter in caring for my wife. Then a letter arrived from another social worker, saying similar things, to the first. I didn't bother to reply. Another letter has just turned up, from the social services legal department, which doesn't say anything specific, but refers to the other social workers trying to visit us. Coming from a legal department, has badly upset my wife, who's recovery was on going, and she now fears that someone will be coming to the house, to do whatever. Do we have to respond, or take notice of these people. Also we recently had a fire prevention officer come and fit, smoke and heat detectors. He didn't voice any concerns with the conditions at the property. Worried, Paul.

    • 05.05.24 Ever so sorry if I have entered this in the wrong part of this website.   My grandfather is in his 70's and retired.  He asked me to help him find a work pension that he was paying into when he was working. From 1967 - 1982 he worked for a Fabric Dying Company, Celanese, Spondon Derby UK. I have already used the GOV.uk Trace Pension Scheme. It listed a few pension companies : Akzo Nobel (CPS) Pension Scheme formerly Courtaulds Pension Scheme.  I do not fully understand how this works but I think this scheme is administer by a company called Willis Tower Watson. We have called this company, got through to the pension department submitted all my grandfather's details (D.O.B. , N.I. no. etc.) but that agent tells that they have no record of my grandfather and ask what is the name of the pension scheme. Here is the problem, his home was burgalled in 2005 and a briefcase which contained his legal documents was stolen. So he does not know who was the Pension Scheme company. I have a this phone number 01332 681 210 for Celanese but it just rings and never gets answered. So I am asking for help if anyone can tell us where we can try next. I am also hoping for a massive long shot that one of them members on this website, worked for or knows someone who worked for British Celanese Spondon Derby and could tell us of any pension company. Thanks for any help.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

How Flipping stupid can they get lol. I just had a conversation with the branch manager of my sisters account, they closed it because she issued court proceeding on charges they took off her of £300. The thing was it was actually the banks fault and not hers. When she went into the branch to draw some money out they told her it was closed and the branch manager came to see her. She put me on the phone and i explained to her why she was claiming the money back due to the banks fault and did explain that to the complaints dept that it was the banks fault but because they do not read any of the letters we send to them anymore they are putting all these kind of complaints in the same bracket. The branch manager said they should not shut her account down because she can see it wasnt her fault but the complaints dept wouldnt even listen to the branch manager. Just goes to show these complaints departments now are not listning to a word we write or say which is again why they have filled the wrong paperwork for your claim lol :D I wouldnt tell them tbh and make them look stupid infront of a Judge. Can someone just clarify something for me? If you are still in a mortgage now and want to swap and you are going to incur an ERC is there anything you can do to not pay it and swap mortgages without paying the ERC?

PPauls I did wonder about that myself and I am not sure how you can actually avoid not paying it . The solicitors doing the legal paperwork will simply send them the figure quoted on the settlement paperwork. They are not going to enter into an argument about its legality.

 

I think we are left to deal with it after the fact, although in most cases it's a big chunk of money that could be better used at thee specific time its paid.

Im mean you really can not let a fine established company like the Abbey make total fools of themselves, I mean they would tell you if had made a mistake if it was your defence, would they not? What has happened to the good old British gentlemanly conduct and batting on a level pitch stuff.

I am starting to think it might have been sent on April 1st Al,

 

I have every confidence in their honesty and integrity and I'll tell them when I meet them in the foyer of the court :lol: and then they can explain to the nice Judge that they need an adjornment so they can come up with a new defence.

 

I'm all for a level playing field Al, but I like one thats level in my favour ;-) and they already made total fools of themselves.

 

I now have so much trust and believe in their competance I am going to get my next mortgage from Tom and Jerry.

Why not re type it and use it as part of your court bundle ? it will also give your some reference point if you do have to go to court.

 

A little bit of reaserch I have done on Abbey Dabby's defence.If you are all getting the same defence I can tell you now it will be struck out.You can not all have the same defence because all circumstances are different.In your case Tam I'd like to be a fly on the wall when the judge slags off Abbey Dabby for wasting the courts time.Oh dear I can see its not going to be a very good November for the banks.:lol:

I also have it on very good authority that they cannot now change their defence. I'm tempted to phone them this week and ask them to send the check immediately and include some extra for the defamation and for me to keep quiet about the lies in section 6 of it. They have signed a statement of truth and to my mind that means the entire defence is perjury anyway and I can prove it :D

Oh just so I record it as I didnt start a thread. I handled a claim against Alliance and Leicester for a total of £1170 on behalf of my ex wife and the cheque arrived this morning so another success :) I based the claim on contractual interest as well :)

lol its cause you get rep from peeps with low or zero rep giving power..... the more green dots you have the more rep giving power you have etc. Black dots tend to give a whole blip at once, whereas one green dot tends to give a few points to count towards one....

 

does that make any sense whatsoever.

A little bit of reaserch I have done on Abbey Dabby's defence.If you are all getting the same defence I can tell you now it will be struck out.You can not all have the same defence because all circumstances are different.In your case Tam I'd like to be a fly on the wall when the judge slags off Abbey Dabby for wasting the courts time.Oh dear I can see its not going to be a very good November for the banks.:lol:

 

Everyone does seem to be receiving exactly the same defence along the lines of peoples overdrafts bla bla bla and this that and the other. So why cant they file the same defence when it is in with regards to charges as most people who are claiming is to do with going overdrawn? We all know though that it would never stand up in court because they cant back the claim but you are making it sound as though they are not allowed to just keep filing the same thing. Like I said earlier they just simply aint listening to what the customers have to say when we write in, and they are just opening up the letters one glance goes in the Bank charges Claim File for some spotty nose kid who has probably been hired on the cheap to press the big red button to print a response ;):D

I have a copy of a defence in front of me that Abbey sent in regard to one claim that is very much a defence against an ERC.

 

Abbey have recently taken all claims back in-house from the DLA Piper that was handling them. My guess is the department set up to handle them has got so many that they are at a total loss of what to do next. I'll also hazard a guess that when somebody realises that poor Inga is sending out the wrong defence she will be for the high jump.

 

As regards using the same defence, every case is individual and therefore the defence should be as well.
