Bailiff came to my business yesterday to settle a debt of £4000 for unpaid rent to my private land lord. We are a limited company and been trading around 2 years. We have no prior warning no letters or documents to say he was coming. We are a small internet gaming centre/internet cafe its been hard but we really don't want to close as we are starting to make some money and cover our costs, its my first business and I've learnt alot but I don't want my dream to end.

 

We are unable to settle this debt currently. The debt could be cleared in the future due to a house sale but not for weeks/months. The landlord is unlikely to discusss payment options or plans, we've been paying small amounts for 3 months.

 

The bailiff visted with a camera and was in our premises around 2 hours. We tried to raise the funds there and then but friends couldnt help and our business banking person was away for the day. We have been given 5 days grace until next Tuesday to pay but as it currently stands we won't make the payment bar a loan or miracle.

 

Is there anything we can do? Sell the company goods to a friend, any sort of loop holes? they want to take everything which at auction will fetch peanuts and we will obviously be unable to trade.

Unfortunately with rent for a commercial premises you only have to be late by 1 day for this to happen. No Court Order is necessary and they do not have to give any Notice before attending. You are going to have to speak to the Landlord about coming to an arrangement otherwise they will carry out removal & sale. I would suspect all your goods have been seized and it would be illegal to now dispose or sell them.

Well a solictor has advised if we can prove they are rented/leased the bailiffs won't be able to take them. Technically they don't belong to both my family and the company as it was family money put into the business to buy them.

 

The bailiff gave us a piece of paperwork which listed the items as MODEMS not COMPUTERS.

Having sought legal advice seems this was a private bailiffs firm.

 

Paperwork seems a bit dodgy/copy of genuine one.

 

Apparently bailiff was NOT allowed to perform a search on myself.
