Yes they did eventually submit those docs to me after a second letter advising them I was contacting the ICO to make a formal complaint for failing to comply with an earlier SAR that they brushed off as an "administrative error" or something. When I sent the letter telling them I was in contact with the information commissioner to lodge the complaint, the original PCN etc quickly followed along with their excuse!

    • The property was our family home.  A fixed low rate btl/ development loan was given (last century!). It was derelict. Did it up/ was rented out for a while.  Then moved in/out over the years (mostly around school)  It was a mix of rental and family home. The ad-hoc rents covered the loan amply.  Nowadays  banks don't allow such a mix.  (I have written this before.) Problems started when the lease was extended and needed to re-mortgage to cover the expense.  Wanted another btl.  Got a tenant in situ. Was located elsewhere (work). A broker found a btl lender, they reneged.  Broker didn't find another btl loan.  The tenant was paying enough to cover the proposed annual btl mortgage in 4 months. The broker gave up trying to find another.  I ended up on a bridge and this disastrous path.  (I have raised previous issues about the broker) Not sure what you mean by 'split'.  The property was always leasehold with a separate freeholder  The freeholder eventually sold the fh to another entity by private agreement (the trust) but it's always been separate.  That's quite normal.  One can't merge titles - unless lease runs out/ is forfeited and new one is not created/ granted. The bridge lender had a special condition in loan offer - their own lawyer had to check title first.  Check that lease wasn't onerous and there was nothing that would affect good saleability.  The lawyer (that got sacked for dishonesty) signed off the loan on the basis the lease and title was good and clean.  The same law firm then tried to complain the lease clauses were onerous and the lease too short, even though the loan was to cover a 90y lease extension!!

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hello,

 

Just called these guys (FPC), they often deal with capital one debts, the girl was on about some "paperless" court and didnt seem to realise defended claims would be heard in a court, anyone have a clue what shes on about?

 

(I have uploaded the call to the attachment).

 

Also she gave permission for me to record.

If they are talking about a 'paperless' system then why are they asking you to put your requests in writing? I don't think we even have a paperless court in this country as of yet! Though I think trials are underway in India :???:

 

seems to me that the girl on the phone may have been talking out of her hoop! I bet she would have been a lot worse to deal with if the call hadn't been recorded though!

I think the idiot is referring to money claim online,

Iv'e never heard of a phone debt being dealt with

in this fashion before.

 

Online paperless claims are a fact have a look at the HMRC

web site for details, Allykat it's unwise to assume that

something does not exist if yo haven't heard of it in my opinion.

ar123 check it out for yourself, and insist that all dealing are

in plain simple writing.

I cant find anything about paperless claims, just stuff from other countries, she said I was wrong when I said a county court claim would be heard in court if defended???

Hi, forget the DCA speak they have a script designed

to confuse, on the HMRC look for MONEY CLAIMS ON LINE

it is designed to simplify straight forward claims for

money only without any complicating factors, this is what

I believe she is referring to.

BRIGADIER I didn't say it doesn't exist, I have a law degree, but unfortunately in Criminal Law :roll: so I don't claim to be an expert on this particular matter, but IMO if the DCA is claiming they need not provide paperwork, then why do they need requests from the client in writing only? If you look at all the information on paperless systems it refers to electronic evidence now being accepted in court.....but what do I know! Was just giving an opinion!

 

Hope someone can advise you further though ar because it's so frustrating when they throw all this information at you without backing it up

I have a law degree to, the MONEY CLAIM ON LINE IS UP AND WORKING, the

misleading term is PAPERLESS, it is not mentioned in the HMRC site on MCO

cases.

Civil law i not my original specific area either but I make myself aware

of developments in the legal system as a matter of course.

as I say I was just giving an opinion, I have checked out the sparce information on MONEY CLAIM ONLINE (and I'm none the wiser tbh) but back to my original point, I still believe the girl was trying to dodge ar's questions and requests for a breakdown of charges etc, and she failed to explain anything! Hence why I made my original comment! It wouldn't be the first time a DCA has misled someone.

 

As I say, I hope someone who can give sound advise on this does so soon :)

I find your attitude mystifying to be honest,

the advice I have given is all I think can be given

without further input from the OC, as a lawyer

you will know the the dangers of postulating on

matters that are not yet clear.!!!

I'm not a lawyer nor did I offer any advise, just an opinion. I am merely interested in this thread as I am dealing with a similar situation :(

OK, I just rang the OC, Vodafone, who own the debt, they are refusing to take payment and say I must pay the dca, I told them I wont be dealing with their dca due to them being incompetent and unprofessional, am I right in thinking I'm well within my rights to only deal with the owner of the debt? Thanks.

fom setting up a standing order to Voda and HOPING

it will get to the right place I can think of nothing that

you an do if they insist you deal only withe the DCA.

I suppose you could keep sending complaints against

the DCA and see what happens.

The point is that they are the autorised

representative of the creditor legally assigned

to deal with the debt, I would assume the

same premise in OFT Guidance stating

that it is unfair to refuse to deal with an

authorised 3rd party COULD apply in the same

way in this situation.

If it is Vodaphone the poster needs to get hold of Lee, the excellent Vodaphone rep on this site.... then they can see what the TRUE facts are and come to an agreement with Vodaphone. They should send Lee this load of spiel.
