These jokers have been asking who was driving the car and that we have to tell them by law!!! now this comes through the post a letter stating 'Possible Litigation' and if i don't respond then they may have to recommend their client solicitor issues legal action and if solicitors are are successful in entering judgement then the debt may increase can't post letter as not got 20 posts...how should I deal with it? many thanks

You deal with it by keeping their latest letter safely in a drawer and do nothing else. That letter ensures they are going no where near a court with their claim, because the courts would take a very dim view on companies lying to people and using illegal threats of court action to scare them into paying invoices.

 

You are NOT required by law to tell tehm anyting

Make a complaint to your local trading standards, morecrap are in breach of OFT guidelines, see http://www.oft.gov.uk/shared_oft/business_leaflets/consumer_credit/oft664.pdf

Not to mention CPUT.

got a letter this morning:-

 

Our records show that despite previous letters you have not made a payment and therefore your account has been passed to our Home Collections division for action.

 

This may involve our local rep calling at your home adrress in the near future to try to assist you and seek to establish how you propose to settle the balance outstanding (£180 lol).

If however you would prefer to agree a repayment arrangement direct with this office, or you believe there is an outstanding query on the account, you must telephone us no later than 17/08/11.

 

We would empahasise that if no satisfactory agreement is made with us or our local rep you may leave us with no alternative but to recommend to our client that solicitors commence legal proceedings against you without further notice.

 

want to ring them and give them a mouthfull but should i just ignore?
