      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

just a quick query as it seems that i panic (on the inside!) as often as you

 

how long did it take from the AQ going to court and a date being set - i ask as inotice we are in the same area of the uk and maybe that has a bearing?

IT HAS BEEN ORDERED THAT:

The case be allocated to the Small Claims Track

My court date has been set for the 11th May, time estimate of 1hour 30mins, not so good, too far away, but anyho, all I have to do now is get my court bundle in by 23 Feb and I'm away with the fairies.

 

No instructions to extend/ particulairse my POC further, which in my mind goes to show that Mr Judge is not taking on board their hot air!!!! However, do you think it's worth me extending them to show Cobbetts just how up-for-this I am?!!!

Yipee Muggins that bit closer.

 

Sodyouall - My AQ deadline was 28th december and my court date is 20th february. I think muggins AQ was similar date but court date a bit further away.

Me, panic, never!!!!!

I sent my AQ in December and did not receive a response until today (06 Feb), but I think that had something to do with the fact that I applied for a remission (fee reduction to likes of you and me!). All in all, it has taken the judge 3 weeks to allocate me to the Small Claims track, which in the scale of things is not long at all, but when you are watching paint dry, as I have been, it always seems to take that bit longer:)

Not lately I'm afraid.

Having just got out of the hospital has slowed my progress down somewhat:D

Had a bit of a set-two with a stupid woman on ebay, though, if that counts? The dreamer expected me to sell her my 3-wheeler pushchair for £3.20:eek: Advised her, in my usual polite manner, that you couldn't even buy one wheel for that. To cut a long, but amusing story short, she has left me negative feedback...how will I go on?!!!!!!

I dont think you will have to wait til may to have this resolved.

 

I hope you manage to stop the account being defaulted,and at least you can use the argument that unfair penalties were a huge contributing factor.

 

I didnt try to defend when it happened to me cos I didnt know I could.

Gosh, it's that lovin feelin' all over again:D

 

Thank you so much for that hope, you really didn't have to, but I'm glad you did:o

Funny you should mention it, but I called Cobblers this morning to find out whether they would like me to further particularise my POC, even though the judge had not instructed me to. I said "that I am in the process of putting my court bundle together and as a goodwill gesture, I would be more than willing to extend them as per their request!!!!"

The lady, not Lyndsey, went away and spoke to her collegue, possibly Lyndsey, and came back to advise me that NatWest are refunding my whole claim and a cheque is in the post today!!!!!!!!

Well you can imagine how I felt:-o:-o

But, I am not counting my chickens yet, although inside I am truely ellated (if that's how you spell it?) but I always air on the side of caution. Boring, I know but it's in my makeup!!!

I will see exactly what they are paying out, send them a lovely letter asking them for what they've charged me since my claim and see how it goes. I'll update you when I receive it.

Yep, sure did. Quite nerve racking really, didn't want to sound like the complete novice that I am at this sort of thing.

Don't go ringing them yourself just yet. Just trying to get my bearings with your case, you've just filled your AQ? I'm sure I advised you it took me three weeks to be officially allocated to the small claims track. If you need to call the court they'll advise you whats going on.

Above all don't get disheartened. It'll all come together soon enough, and this comes from someone who has been sitting on the payout fence for what seemed like an iceage:)

That's good news, I will be watching with great interest as our court bundles are due in the same day, court date is near enough same day, so hopefully our payout should be nearly here as well!! Might ring them for the third time tomorrow and find out, or go and find the postman before I go to work! Now, should I do the court bundle or not??!!
