Phone bill incurred by a stolen phone

Hi

 

My friend just recently lost his phone during a holiday abroad. We tried contacting Orange for the entire evening and night but we were put on hold and couldn't get through to the stolen phone reporting (which incurred me quite some overseas call charge!!)

 

We were able to bar the SIM the next morning but the phone had been used during the evening and night... which incurred £50 bill.

 

Orange says he is liable to pay the £50 incurred because he failed to report the phone stolen.

 

However, we made every attempt to report the phone stolen, it's Orange who failed to answer our calls!

 

Is this really fair and "legal"?

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

Email him, you contacted them to report it stolen immediatly and it was their incompetance that didn't put the bar on it. Ask him to "Please sort it or reply with a DEADLOCK letter, as wiping that amount from the bill is the only acceptable outcome"

If in doubt, contact a qualified insured legal professional (or my wife... she knows EVERYTHING)

If you've got evidence that you called and they didn't answer then your in a strong position to request a refund, you'll probs understand though that the "I tried to call you" line is something that they'll probably hear all of the time, they may not believe you without proof.
