Im sure i read once that a parking ticket should have colour of car on it - without its invalid, have had a look round google and cant find anything related to this.

 

anyone know of it?

Have already posted to Chadley regarding colour issue, ticket should be invalid if colour missing or wrong. The word 'Offence' is not allowed because there has been a decriminalisation regarding parking misdemeanours - the word contravention must be used. Lots on this site about this, so worth doing a search. Hope this helps!

As far as I'm aware incorrectly stating a vehicles colour will not invalidate the ticket. A court will make allowance for minor errors on tickets because the bottom line is that it makes no difference as far as being to identify the vehicle is concerned so isn't prejudicial to the administration of justice.

 

If the make, model and VRM is correct then that's good enough to identify it.

 

Also, how would you identify a vehicle such as those limited edition Polo's that VW turned out a few years ago where each panel is a different colour? The little Smart cars rarely show the colour that is listed on their V5 as the major coulour as a percentage of the vehicle. The plastic body panels are interchangeable so the colour on the V5 is actually the colour of the painted metal bits which are the bits that can't be changed. The colour of the car in the picture here is black, not red.

Fob-off letter received 23/8/06, letter sent in return same day - Delivered 24/8/6 Recieved letter offer 25% settelement - refused - LBA sent. MCOL on 10th revcieved notification that they intend to defend on 13th. 06/9/2006 WON!!!!!!

As stated in Chadley's thread, the colour of the car can invalidate the ticket - but really obvious errors like green not red, black not white. Shades in between will normally go in favour of the issuing authority - after all, the car has been issued for a parking contravention and unless the model is wrong nine out of ten tickets will stand.

Thats because yours is not a local authority ticket. By not putting it, you can't say they got it wrong.

Hi,

can anyone help?

 

re: fixed penalty

 

my wife parked in a street AWAY from our kids shcool, (there are lines in front and across the road of the school) up a side road adjaicent, where there where no yellow lines.

 

A pcso (or whatever those new assitant police officers are called) give her a ticket for "unessessay obstuction" when the car was parked on the straight part of the road, but near a bend NOT on the bend.

 

The ticket states the car as being Grey, when it is silver, there is only one date ("on 13/03/07) it has the word offence in it, not contravention and the street name looks like Maple Grare instead of Maple GROVE before i just go a head and pay it, do you think i have any grounds to appeal it? and if so do i just send a letter or ask for it to be dealt with by the court?

 

any ideas would be great!

Hi

As an x police traffic warden sorry to say you have no grounds for appeal colour is uninportant,offence is the correct wording as it is a PCSO issuing not the council.

The only chance you might have is to prove your wife was not causing any obsruction how far from the bend was she parked could vehicles pass her safely.

As this is an FPN issued by a PCSO, it's only function is for you to decide to pay and end the matter ot opt to go to Magistrates' Court to fight it.

 

If you opt for Court, the FPN is voided by the issue of a summons

 

Only in the PCSo's statement to the Court do the details have to be correct.

mine doesnt have a colour at all, no space for one either. also doesnt have make or model, only the registration???

 

There is no requirement in law for the colour of the vehicle to be written on a PCN. Thus not having one at all does not void the PCN.
