hi all

new to the site i have read with interest the numerous posts regarding lowell portfolio as i have been getting random letters from them and red debt collections regarding a debt they bought from lloyds tsb,

recently the letters have turned to phone calls at stupid times of the day and night (most recently 11:15 pm )

 

the only debt i can remember having with lloyds tsb was when i was going through a divorce (2001) this was simply bank charges as i remember

 

any advice on how best to deal with this would be greatly appreciated

if as you say its from 2001 then its statute barred, however Lowell (red belong to Lowell's) specialise in buying up debts that are due to be statute barred and the try their damnedest to get payment using all sorts of tactics, like threatening to come round and remove all your goods, getting you committed to prison, getting court case against you that will be in local paper, they even said they knew my car reg and would come round at night and remove it (strange that I dont drive or own a car). They work on assumption if 3 or 4 out of 10 pay they cover the ones that dont. If you take your time to look around site you will see several threads about lowells.

i'd actually answer the phone and make sure you get them to ID themselves

 

then contact the OFT with the recording!!

 

thats VERY out of order

 

seriously fines for that.

 

pers i'd ignore them

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

hi all

just a quick update , today i recieved a letter from lowell portfoilio, stating they did not hold copies of my original agreement , but have requested them from lloyds.

 

they also say ''there is no legal obligation which states we must send the information within a certain time period ''

 

do i just wait for the copies of the original agreement ?

also i forgot to mention i got a copy of my credit report , which was clear , am i right in thinking this sort of proves that there should be no outstanding debts against my name ?
