      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I have been getting daily texts from Frederickson asking me to call despite them failing to provide a CCA

 

Has anyone else had text harassment from Frederickson.

 

Im investigating how to get these blocked with Vodafone.

But if anyone else has any experience of this let me know

i suspect its going to be tricky to get this stopped as i doubt laws that cover phone calls cover text messages as well.

Currently Pursuing three credit card companies for PPI and charges.

 

Capital one: Sent the required SAR information late, currently working out my claim.

Egg: Sent the required SAR information on time, curently working out my claim.

Virgin/MBNA: Still waiting less than week left to copmly with SAR.

Option 1. Ignore

 

Option 2. Every time they send a text press reply - key in #### off. Hopefully they will eventually get the message and realise they are wasting their time.

 

Blocking may not work as they use so many different numbers.

I find the direct approach works best, after all, they are harassing you.

Pretty much doing option one as it is but

 

they send them at annoying and inconvenient times like 10pm when im trying to get to sleep

I know they are not allowed to do this with phone calls and i have blocked them but cant block the texts.

the odd thing is the texts numbers are withheld which i didn't think was possible.

 

would like to tell them to to go somewhere else but not convinced this wont make them more determined.

like the idea unfortunately they withhold the text number

it just says Frederickson's!

all the other numbers they call with are blocked and i voicemail screen unknown numbers.

 

I do think companies should not be allowed to withhold their numbers

there is no legitimate reason for doing so.

Formal complaint to Ofcom http://www.ofcom.org.uk/contact-us/

 

And make a formal complaint to your local Police station and report that you are being harassed.

There is the protection from harassment act, admin of justice act, communications act don't think I have missed any laws they have broken? Get complaining and reporting, otherwise they will continue to ignore the law.

Who ever heard of someone getting a job at the Jobcentre? The unemployed are sent there as penance for their sins, not to help them find work!

Hi Bazooka Boo, i cheked the ofcom website and for texts they say that i should contact the caller first and if they dont remove me the to contact ICO. Not sure what they can do sadly soudns like a typical government departemnt cop out.

Will give it a shot if nothing else it will raise there profile with the ICO if they get enough copmlaints they may investigate.

A little update for those who maybe interested whilst i have had no reply from my complaint to either Vodafone nor Frederickson's

 

they have stopped texting me so it seems i dont need to complain about them to Ofcom.

 

and once again thanks to those who offerd advice.

Everyone should complain about harassment from DCA's ASAP, this is why nothing gets done because no-one complains about it. When they start up harassing you again Goatan you MUST complain.

Just to add my two pennies - when my mum was being harassed by my abusive father, she tried calling Vodafone to get his number blocked and the Indian guy at the end of the phone told her to just buy a new phone and SIM card. My personal experiences with their customer services aren't much better, I'm afraid. Apparently though as soon as you get a crime reference number of sorts, they bend over backwards... *shrugs*

 

Hopefully the gits will leave you alone though!

My partner has had many texts from Fredrickson concerning a debt which has now been settled. We have written and advised them to stop the harassment and they still continue. ICO next.

 

OFT&TS via Consumer direct is your first port of call, then,

OfCom,

Your local MP,

BBC Watchdog.

well they briefly stopped but have started again. time to complain to those on bazooka boos list, i will also try 247orbital's suggestion.

It's disappointing to read about your mum's experience here and to see that this situation wasn't handled better.

 

We do of course have processes in place to assist customers who are the victim of nuisance or abusive calls/texts and more information on these can be found here.

How come Three and the likes of other Mobile Phone companies do not have great people like you acting as a online consumer relations officers? Tell you what, if three did i wouldn't be having the issues i have with lowells anymore as am sure if it had been vodaphone you would have got it sorted out by now :wink:
