hello please can some one give me some advice ,i got about 6 debt firms after me ....RUTHBRIDGE,TBI,BCW,DCL,MAC HALL,GREENWOODS ETC is there any way i can stop paying these bloodsuckers all my money each month or not...thanks

I do think a smidgen more detail would help. If you start a thread for each debt, giving as much detail without identifying yourself.

 

Use this thread for one of the debts-your choice.

 

What is the debt?

Are you working?

Are you on any benefits?

Do you own property?

How old are the debts?

 

DCA's have no power over you. Only a judge has so you should be paying what you can afford, not what the DCA's want.

 

Have you checked to see if the DCA's have the right to be chasing these debts?

Do you know if there are any unlawful charges put on any account?

If you are asked to deal with any matter via private message, PLEASE report it.

sorry right WELCOME FINANCE DEBT 2002 RUTHBRIDGE STARTED CHASING ME IN 2008

HFC LOAN DEBT 2002 TBI STARTED IN 2008

PROVIDENT DEBT 2009 BCW STARTED THIS MONTH

 

they are the ones i got paperwork/letters etc for been paying ruthbridge 100 each month got it down from 4000 to 1700 now i only pay 20 a month,tbi i pay 100 a month got it down from 9700 to 7000 ..i got a mortgage which i owe v120000 on with no eq and i am behind 4 months with payments ,i work two jobs

The first two debts; Welcome Finance & HFC the dates you give, are these when you took out the credit, or the last time you paid anything toward them?

 

Are these both Loans?

 

MUCH MORE IMPORTANT!!!

There are PRIORITY DEBTS, & Non Priority debts.

Your IMMEDIATE priority ,is to pay your mortgage FIRST,

Then it will be your council tax, any court fines, and utility bills, TV licence.

THESE ARE YOUR PRIORITY DEBTS, you MUST keep a roof over your head, Non Priority debts are what these foolish idiots are after you for, so anything that is not secured on your property, loans, credit cards, pay day loans etc etc etc, they ARE NOT priority debts.

 

Get your house in order first, do your OWN I&E sheet http://www.nationaldebtline.co.uk/england_wales/budget_sheet.php?country=england_wales

Work out on there exactly what you have coming In & going Out, don't forget you need to have a life, beer money, fags, clothes, cinema, pizzas, spearmint rhino nights out etc etc, whatever you have left over, is your disposable income, that can be divvied up between each of the vultures.

 

Being in debt IS NOT a CRIMINAL offence, you cannot go to jail for being in debt, UNLESS it is for non payment of taxes, TV licence, court fines etc, consumer debt will not put you into jail.

 

ANy threat these imbeciles state in their letters is pure and simple fantasy, there will be no court, no bailiffs, no doorstep collectors, no agents or field officers, there is a lengthy process that has to be gone through in order for court or bailiffs to be brought into the equation.

 

If you work out your I&E and find out you cannot afford to pay them anything, then that is all you need tell them, if all you can afford to pay them is £1 a month, then that is all they will get, DO NOT talk to ANY of them over the phone, KEEP EVERYTHING IN WRITING, if they ring, TELL them 'everything in writing' and hang up.

 

I cannot stress to you enough the importance of paying your priority debts FIRST, these parasites would much rather see you out on the street than paying them anything, because to them they ahve maintained their one rung up position.!

Who ever heard of someone getting a job at the Jobcentre? The unemployed are sent there as penance for their sins, not to help them find work!

Well firstly you need to be paying the most important debts-the mortgage, utility bills, food etc.

 

Any debt that isn't a secured can go down the food chain (loans, hp, credit cards)

That will give you some idea of what you have to play with.

 

If you don't think you can sort this yourself, try giving CCCS or Payplan a ring. If you have enough money available after taking off essentials, they will help set up a Debt Management Plan (DMP)

If there has been any 6 year period with these debts (5 years in Scotland) where you have not paid or said (in writing) that this is your debt, they may be Statute Barred.

yes the welcome and hfc debts were taken out in 2001 and i became ill in 2002 and stopped paying them ,and then the bloodsucking gits came after me saying they would make me bankrupt thats what ruthbridge said anyway .....ANOTHER ONE DCL SAID THEY WOULD PUT A CHARGE ON MY HOUSE FOR 540POUND can these fools do this...NOW i have got into the payday loan trap borrowing money off one to pay another..

Sounds like you are being chased for debts that are statued barred - seing more and more of this lately.

 

Can you confirm - that on your welcome and HFC debts you LAST made a payment in 2002?

 

If so we can send the statute barred letters - but can you please conform what i have said is correct so we can take this down the right path.

 

As others have already advised - pay you priority debts first - only offer to make payments to non priority debts based on what money you have left over. If all you have left is a £1 then offer them the £1.

 

BUT - if they are statute barred offer them nothing - there is a letter in the library you can send. Will give you the link if they are stat barred.

It sounds like the two loans, Welcome&HFC are statute barred, but you must be very confident that you have neither paid them anything or written to them admitting you owe this money within the last 6 years?

 

That just leaves provident, they can wait until you have got on top of your Mortgage payments, simply write to them, explain that keeping a roof over your head is a priority and until you have got back up to date with your mortgage payments all you can offer to pay them is £1 a month.

I HAVE Been paying the ruthbridge and tbi each week for 2years now so i cant stop can i and also today a letter from dcl came saying they were going to put a charge on my house for the £500odd pound i owe them can they put as charge on my house for such a small amount

I'm not an expert, but what everyone is trying to establish is if there was a clear 6 year period between 2002 and 2008 that you did not pay anything to HFC and Welcome. If so then then both these are statute barred and it dosent matter that you have been paying for the last 2 years.

£500 charging order., I think not over £750 may be if I am right??? to get a charging order would of meant they obtaining CCJ and you not paying required amount of payments then they could apply ( if they actualy own the debt)??? if they have not assigned the debt -( they would have to apply to the court! if they owned the debt anyway)

Might be an idea to put a complaint into FSA for these idiots. FSA debt guidelines come to mind they must adhere to.

Johnnycee, slow down, whow up.

 

Put a charge on your house, in there dreams babe.... First need a CCJ and your no where near yet. Secondly, you can stop paying who you like any time you like. God forbid, what happens if you were in a comma???? who would pay... Firstly, how much can you afford these people with the debts that are enforceable, work it out, make an offer and tell them if they don't like it see you in court. Why oh why do we still see people paying over the odds going without food or fuel. This is the 21st century in a developed country.

 

Johnny, time to cancel any payments until you have worked out your finances properly then time to start checking for charges on any account with a SAR and a copy of your CCA. Listen to the people on here, they will guide you in the right direction. Take no nonsense from these demons of hell.

Stay OFF the phone, DO NOT TALK TO THEM everything has to be in writing only as they will exploit your lack of knowledge and fleece you blind.

 

Concentrate on the exact dates you stopped paying anything, and then the exact dates you started paying them again.

Hope your dates are wrong as would hate to think you were only a few months away from it being statute barred. I would definatly double check your dates only becuse you say the likes of Ruthbridge and previosly you say Makenzie hall were chasing you? Alarm bells start to ring that somethings not quite right.

thre ruthbridge one which was the welcome loan went to moorcroft first and then ruthbridge fgot there hands on it..the mackenzie hall one was for a black horse loan in oct 2007 which was passed on to aic then to dcl which are giving me s..tnow by saying they will put a charge on my house...the hfc loan which tbi have got the dates are correct ....i have 1 bcw ,2with dcl which one is coming out of my wage each week, 1 with ruthbridge,1 with tbi ,2with erdupt co, plus other payday loans which i have not heard anything of ages..wonga,quickquid ,txtloan,speedloan,accessfasrtmoney tghe list goes on..doing my head in..

Go to Amazon and get your self a copy of a book called "The Money Secret" you can pick it up for about £6/7 including postage - may be less. Will help you get your head round things going forward.

Contact Experian and Equifax - get your statutory credit reports £2 each and completely digest the info on there. Then start to get information from the original creditors. Don't panic. Deal with the low lifes chasing you first and don't speak to anyone on the phone

Hi there OH DEAR there is a bit of "dubious advice" here.

 

The problem arises when you try and classify debts as "Priority" and "Non Priority".

For Property owners debts need to be looked at differently.

 

These days even CREDIT CARD debts can be turned into SECURED DEBTS by the nasty mechanism known as a "Charging Order" which effectively secures your HOME against originally UNSECURED Credit card debt (for which the Banks were already charging a much higher rate of interest).

 

Nowhere on the original CCA does it even mention this possibility but unfortunately its legal. They do have to get a CCJ and go back to court 2 times more to make this stick but it IS a factor and although a Court is unlikely to force a sale of your property some DCA's such as CL_Finance etc have been known to threaten peope with the loss of their home for really smallish amounts of Credit Card debt that they purchased for pennies in the pound anyway.

 

So if you have money it's better IMO to pay off the debts that have higher interest -- and provided you don't leave it too long let the Mortgage arreas mount up for a few months as the interest on these is usually of AN ORDER OF MAGNITUDE LOWER than credit cards etc.

 

However if you DO use this strategy ALWAYS HAVE ENOUGH TO PAY OFF ARREARS if you get snotty letters from Banks solicitors.

 

This tactic won't suit everybody but in general unless you can get the debt wriitten off it pays to clear the debt with the highest interest first so long as you don't lose your home of course.

 

You might be able to arrange with your Mortgage company a "Mortgage Holiday" or very reduced payments while you are clearing off other debt.

 

Whilst I'm no friend of Banks they usually DO look more sympathetically to people who are realistically trying to pay off debts and have some sort of plan in place so you will at least get a considered hearing on this one.

 

Note that COUNCIL and INCOME TAX MUST be dealt with FIRST -- these DO take priority over everything else but Councils can usually be accomodating PROVIDING YOU DEAL WITH THE ISSUE BEFORE GETTING LIABILITY ORDER / BALIFF NOTICES.

You realy need the dates as some of those debts may be stat barred - and not need repaying.

 

As for anything else.

 

Have to disagree slightly Jimbo. Something like a mortgage may not have the highest interest rate, but as it will generally be the biggest debt, will attract more repayment. Missed payments include more interest on all ready high amounts.

 

Besides that you do not want to be homeless.

 

First should come

 

Mortgage/Rent

Council Tax

Court Fines/maintenance

Gas/Electric

HP - if for example a car you need for work - or an appliance needed for the home (cooker/fridge etc.)

 

Then pay off your other creditors - and yes go for highest interest rate first.

 

If you are taken to court, the court will only make you pay what you can afford - they will not like cissueing charging orders, attachment of earnings etc but will do if you do not keep up payments. So work out what you can afford - and pay that.
