    • Yes, send a message to the purchaser but keep it very friendly and simply that you noticed that the package has now been delivered.  I suggest that you ask them if they want to keep the package still or if they would rather return it and that if they want to keep it then please will they return your payment to you to your PayPal address. Keep it as polite and friendly as possible and then we will decide what to do if he doesn't reply or refuses.  Meanwhile I will have a look at Google earth and see if you are able to spot the gas meter outside the house to get an idea if the delivery is real. Get a screenshot
    • Santander have sent their final response and have agreed that they were in the wrong. They will be refunding me the amount I am due and £50 for the delay.  Just the interest factor would be more than double the £50 that they are offering. Thinking to just close this and move on. Is this what you would do?  Opened a FOS case on the 1st of June but haven't heard back yet. 
    • It just been delivered and ive had a live chat with p2g to get some proof of deliverey and they send me a picture of the parcel placed in a gas meter box which they class as a ' 'Safe Place'  and not placed into the hands of the buyer which is either a good thing as the buyer can claim he never received It so i can claim against p2g or a bad thing . Do p2g have coordinators when taking pictures and scanning of parcels ?  I know Royal Mail do ... I'm going to send the buyer a message and see what he says

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I wonder if I can get some advice from anyone please.

 

I purchased (ordered) a corner sofa in July 2011. The woman I spoke with was giving all the talk up about the sofa and that it would take 6-8 weeks and because of the time I am ordering some of them would be on holiday. I said ok.

 

However I specified I wanted this at the end of August, she said this would definitely be ready by then. On my reciept she put 8 weeks.

 

The second time I visited the store to put my first deposit down and to double check this is the piece I wanted, a man with dark hair walked towards me, I mentioned I spoke with a woman before and she would deal with it, as soon as I mentioned women he turned his back and went straight back into the office again, I found out his name was Mark (his needs customer etiquette classes!!)

 

I then started paying down on this sofa with my debit card, 3rd visit I asked a male in the store if I could have a date for the sofa as I need it sooner. There was another male in the store with a long pony tail sitting next to him. The man said to me if it is not ready we can turn this around within 7 days.

The next appearence in the office I wanted to see if the date has been set and I paid for my sofa in full, I was then told they were on hoilday and my sofa has not been made yet, they will call me.

 

I left it a couple of weeks after, I turned up again asking for the whereabouts of my sofa. A spoke to a woman who sits behind a desk and called the 'so called' factory and they stated I would get a delievery date the beginning of the week, this was a couple of week ago. She then wrote my number down and claims she would call me.

 

Can someone tell me:

 

1) If I am told my sofa has not been made yet do I have a right to cancel.

 

2) If they have put 8 weeks on my receipt according to the date on the receipt if they go over that does this count as a breach of contract?

 

3) Also I have read on some blogs that money cant be refunded if purchased by debit card is this right?

 

I hope someone gets back to me?

Hi,

To confirm my receipt also says els. We have also had a similar situation with this company. They promise anything to get the sale and then if anything goes wrong its the customers fault they have no customer service skills at all.

 

To anyone out there looking to buy a sofa be warned don't use this company. I will be advising all my friends and work collegues to never use yes sofas. I already know of two people who live locally to me who have had the same problems wrong colours, damaged sofas etc. and the way they treat you is terrible. Lies after lies.

Hi all,

My first post on here so bear with me,

We ordered a sofa on the 3rd september 2011 from the droitwich store and paid 400quid deposit, was not asked for the rest of the money but a week before it was due we would get a call to confirm the payment and pay the rest

We were quoted 8 - 10 weeks for the delivery, which was fine as we were having work done in our house.

After 11 weeks, no sign of the delivery. When we phoned them, they said they did not say 8 - 10 weeks and would be delivered on the 18th december.

Today is the 18th decemeber, no sign of them. Went into the shop today, Basically to cut a long story short, we were in their an hour, with no avail.

We work hard for our money and we wont let this go without a legal fight. they want the rest of the money, but they cant confirm when the sofa is coming. They said its coming wednesday, but it says on the recipt the CONTAINER is comign wednesday, but doesnt mean the sofa is coming then.

We looked on here, and thanks to others, we are ringing the tradings standards number tomorrow.

We are telling everyone we know not to go there, and know of at least two other cases where they havnt paid / got their goods. DO NOT BUY FROM THIS COMPANY!!!

Hi, we tried to cancel our order as it was still in production but with no joy, but we got legal help from our house insurance who were prepared to take them to court on out behalf. Worth a try if u got legal cover? It def helped push things along once they started receiving letters from our solicitor. We paid debit card so this was the only way we could get a refund, eventually we just got our chair delivered. But if they have stated a delivery time they are legally bound to deliver by then otherwise they are breach of contract.

Just registered to say thank you to everyone on here for flagging the poor reputation that this company has.

 

We visited the shop yesterday and saw a sofa that we liked. We were likely to go back today and put a deposit down. We won't be doing that now.

Just a quick reply from me.

Eventually spoke to head office in birmingham, and got a refund on our sofa.

I would delete the post on here but apparently this website does not allow users to delete their post, if anyone knows how you do i would be grateful

Thanks to the birmingham office, they were extremely helpful and efficent and obliging.

Having had to go back into the droitwich store, found the salemen slightly more pleasant than before

In the last 12 months there has been a raft of complaints about this company,we do not appear to have had any updates for some.
