    • You did what??? You asked them to send you the documents that without them you had  a 100% ironclad win in Court. Why on earth would you do that? As it happens in this case, there is still enough mistakes in their PCNs and the NTH to have your case cancelled. Amd it may be that not sending those documents in the first place along with the ICO complaint and the letters from Alliance themselves which would confirm by the dates on the letters may be enough to cancel it anyway. I hope you have kept their letters as evidence? The chances are that Alliance will not actually take you to Court because of their errors but you never know.  You have made so much extra work for yourself in your WS if they decide to push their luck.though. Can you please post up their letter where they give the reason why I wasn't sent with the NTH.
    • I'm not sure that I fully agree with my site team colleague above.  My understanding is that there is nothing to stop you recording but it is strictly for your own personal use.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Can someone help please? I run a self employed delivery business with my own van. I had insured with the company Gladiator for two years. The first year I paid by a lump sum, the second year went on intallment,direct debit. When this year's renewal came, I decided not to renew as premium increased more than I expected. So I cancelled my direct debit instructions and assumed it will be cancelled as they cannot collect money.

20 days after they wrote to me saying I owe them money demanded payment. After a few to and fro, I discovered the policy was on automatic renewal, they had say so on the renewal notice but I did not notice it as I thought non payment meant non renwal.

Anyway, I cancelled it but they said I own them over £300. The amount includes 20 days of insurance and a admin charge. The original premium was £1200, can they charge me 1/4 of the amount for cancelling? They threaten if I do not pay, they will pass it to debt collectors and the amount will keep adding on! What can I do? They are blatantly ripping me off! Please help.

I am just letting you know that as you haven't had any replies to your post yet, it might be better if you post your message again in an appropriate sub-forum. You will get lots of help there.

 

Also take some time to read around the forum and get used to the layout. It is a big forum and takes a lot of getting used to.

 

 

Once you start to find your way, you will soon realise that it is fairly easy to get round and to get the help you need.

 

It can be bit confusing at first.

You need to write to them to apologise for your mistake in not realising you had to contact them to cancel. Send them a copy of the new policy certificate, showing you have cover arranged elsewhere.

 

Hopefully they should accept your mistake and cancel from renewal, without anything owing.

 

If you are unlucky, they will say it is not their problem and ask you to pay. If this is the case, you should think about making a formal complaint threatening to go to the FOS. If you went to the FOS, 8 weeks after not resolving with the company, they would get charged a case fee of £500 and it would cost you nothing. Also the good thing about making a complaint and entering into a dispute, is that they should not then pass for Debt Collection. As you will note from the Debt forum, it is against the OFT's rules for Debt companies to take on debts that are in dispute with the original creditor.
