    • Replying to above  this was on the day that two store detectives approached me and my friend and took us into the back room and spoke to us when they explained they have been watching
    • as my learned friend above...and.. sadly because just like DCA's and initially yourself in this case, you believed they have some magical powers ...they DON'T. 85% of people blindly pay DCA's cause they know no better and think they are BAILIFFS. only the RETAILER can ever do court and none have done this on a silly member of joe public that did something stupid since the infamous 2012 Oxford case on retail loss. BAILIFFS can only ever be involved after you've been to court and lost a CCJ, fat chance re above... and anyway, no BAILIFF has any right of forced entry anyway on consumer debts even with a judgement so......... stop panicking and thinking everything that doesn't apply.. forget about them but p'haps a confidential GP visit might be a very good move... what slightly concerns me more here is:  who are 'them' that told you they'd reviewed a week of CCTV and come up with several shoplifting instances over that time amounting to the above? have you directly contacted or had contact from Sainsbury's? and know they HAVE done this? or is this DWF willy waving and they tricked you into  admitting several previous successful thefts... this is not the norm...  dx      
    • next step then await the N157 from her local court giving the time and date of a future hearing some month in the future. now she MUST file a witness statement 14 days (typically) to both the court and kearns .  so cant allow to much of a time lag before you are aware of that and get her WS done. wack us up 2 multipage pdf files please  one of what they returned for the CRP reply . and one for everything they sent back in 2022 you've found.  we do not need statements. ideally it would be nice to see their WS before hers is finally filed. dx

    • DWF can't do anything as they act for a client. In this case, Sainsbury's. Sainsbury's could take you to court and ATTEMPT to get a CCJ but it's unlikely. They had no interest in dealing with you at the time. All DWF can do is send out pointless threatograms. They'll threaten to divert an Iranian drone to your house if you don't pay. However, they can't attempt to get a CCJ against you. IGNORE THEM. It's more important now to understand why you were allegedly shoplifting, and you should speak with your GP and try and get yourself signposted to the support that's available.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Appreciably, you will understand seeing that can have, when most letters coming are from DCAs or creditors. Turns out it was from Readers Digest whom I don't have anything to do with, about a competition I never entered anf my name is 'guaranteed' a winner place if I phonr and confirm. Not that I will be but, really, what a thing to put on an envelope. I am still trying to getm my breathing back under control.

Missed these other replies because I was out, did hear my phone go 'ding' for an incoming update from here but was too busy listening to music :D.

 

I was also curious to note that Readers Digest (or the marketing or 'a' address on the back) appears to be in the Isle of Man now. I mean, I never really believed I'd won £125000. Last time it was a golden coloured tear off the strip thing ages ago.

 

Edited - oh, and look I just found a DCA listed in IOM on Google. Well, the one I found. (Or it's listed on a site after looking up DCAs there).

And jolly naughty of them, too! But the other way gives me an excuse to visit the island, never seen a Manx cat for example. Besides I have googlemaps on my phone, have been very entranced looking at Easter Island, NY and other places.

But then I just thought, that if I used Googlemaps I may get the wrong view/address ... some of the information on there's a bit 'inaccurate' ... and not from personal knowledge of an area I know them to be ... which is also what DCAs do, of course. ;)

Don't worry, always do. In fact getting rather sick of the large collection that's amassed over time. I'd really prefer not to be getting what I consider junk mail for example and then having to keep it in the house.

Yes. It does seem a 'coincidence' because ... I had an odd text (second one) ... I won't post what it said but it was like the letter but 'offering' me something (only people who should have my number are one friend, one family member and the phone company, it's not anywhere else eg in the public domain) and if I wanted the texts to stop to text 'STOP'. Fishy. Considering the contents of the message. Of course, it arrives same day as this envelope does. I hadn't thought of them being connected but now you posted what you got today I am now thinking or linking them because of the timing. I haven't looked up the number yet as it's also a mobile number I don't recognize.

 

Mmm, just checked and the subject line is 'FREEMSG'.

 

Edited, it's nowhere online, either. I remember I did check it out before when I got the first one, couldn't find it. Which, if it was a company others would have had the same text if it was some kind of marketing thing. Unlike the DCAs that use certain numbers other than their normal ones, so you don't know who they are. Mmmm.

Found it! Or at least the code and part of the number matching the one I have, it's a company offering to write of loans legally.

Yes, you're probably right re the coincidence. I had to reach for the inhaler - still getting used to the things after just a week - afterwards, though as I could see in the very large window a few things that looked like account information on full display if you just pulled the corners back a bit, then looked at the back.

 

Thanks for the link CB, I found it eventually. It's the third one down I had the texts from in my post above. SMS [problem] by the looks of things.

Well wadayaknow? I got a new debt collector's letter today and from one I've never had the pleasure of before, 72 hours after the winners notification. Nothing from Readers Digest, though. Coincidence? Least it also answers the witheld number that has been calling my phone this week, no message left ... can only mean a debt collecting agency.

Best way to deal with these "txt2stop" messages is ring your phone company and they can block the number at source. I had one where I texted STOP but it kept saying I needed to confirm.... seemed it went to a very high rate phone number and routed round several other numbers.... 02 were able to stop this at source.

Thanks for the tip. I've been trying to block it from the handset but seeing as it's an android phone it's pretty useless on letting you do that, I could do it from an older generation one for example.

 

BPO, Glasgow. Not MBNA, though. Amazing how many DCAs seem to use Glasgow as a base isn't it?

No applications you can put on it to block calls or create blacklists?

I could have a look. I'm not annoyed by the calls, though I would like to know how they got hold of the number because the creditor doesn't have it, either. Not that I ever answer them anyway because I know who has my number and they wouldn't withold it, so I can see and answer when they do. They appear very reluctant to leave messages. ;)
