    • Yep let us have a good laugh eh from today’s Telegraph 🤣😂🤣 the rest must try harder    Farage won Friday’s election debate, a poll finds Nigel Farage won Friday night’s seven-way BBC election debate, according to a poll.  A snap poll of 1,031 voters by More in Common found most thought Mr Farage won the debate, followed by Angela Rayner. Mr Farage received 25 per cent of the vote while Ms Rayner received 19 per cent. The Green Party’s Carla Denyer was the third most popular with 11 per cent, Stephen Flynn for SNP received 10 per cent and Penny Mordaunt, the leader of the House of Commons, took 7 per cent of the vote. Daisy Cooper, the deputy leader of the Liberal Democrats and Plaid Cymru’s Rhun ap Iorwerth took 5 per cent and 2  per cent respectively.     • Hi CAG Team, I'm seeking your skills and help for a NtK my partner received through the post earlier this week. To give a little backstory, my partner and I, along with our young children (4 and 7), decided to go on a camping holiday about 3 hours away from us. We took a car each because we didn't have enough room in one car. We arrived at the services at very similar times as we followed each other the whole way. So, two cars. My partner has received this NtK, but I haven't. This NtK dropped through the front door on Wednesday, June 5, 2024.  We both parked in the Burger King car park, not in BP; we got out, all went for a toilet break, got some food from the BP garage and returned to our cars to eat.  After eating, we took the kids to the toilet again before leaving to complete our journey. I didn't notice any parking restriction signs and can't get back to the location due to how far away it is. I noticed another person had an issue here and reported it to you, and they managed to get the charge dropped. See below. To me, it looks like they have cameras at the complex's entrance and exit. I'm not sure if they own the land/car park by Burger King, I'm not sure if this is a legal contract or not.  I find that 30 mins limit at a Services that serves hot food to be ridiculous and unfair, especially as we had kids to feed and water.  And the fact that I didn't receive the same NtK despite us driving in and out together is just crazy. This is the location - I also uploaded a map image.       On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

If you want a box of tissues for your sob stories, I am certain that your local shop will still be open at this time of night.

You don't know me, either but now ... wrong words to be saying to me or anyone else for that matter. I have pity for someone ... As to 'sob stories'. Well there is nothing about a little bit of 'hellzapopping' righteousness is there? Sob story? Come look in my eye, I will show you humanity but I will also show you what compassion means but also pain, despair, but I don't quite know what pieces of clay have to do with anything, either. I am not malleable, not at the will or whim of others, I am my own person, I make my own mind up. I left the church behind ages ago because of 'whiter than white' attitudes and not one iota of compassion for anyone.

 

However, my thoughts are always with the victims of wrongdoing (I won't even get into what wrongdoings that have been done in the name of the church over the centuries as this is not the time nor place but you did bring it up).

 

So, don't even begin to get righteous with me as you have not a clue what I have done in my life, nor how I am as a human being. Your words are totally, utterly wasted. Like I said I have pity for someone ... Can you guess who?

On a more serious note...Mould I have just browsed your Threads and Posts, and I am impressed by you concerns, help, and equally the advise you have offered fellow cagers, newbies and even the more experienced member.

 

I think it would be very foolish, and a great loss to you and us if you were to de-register ( leave ) this forum, there is no humble pie here, so sit back, relax and stop biting before this thread gets ' pulled '.

 

IMHO, I think the Father is wrong to do what he has, however that is not for us to judge, personal stories will come flooding from members as a result of his wrong doings. however we all must get on with our own personal fights, and await the outcome before we all pass judgement.

I have unapproved another of The Mould's crayonings, even at the risk that he will follow through on his threat to leave and never return. This is because the post is clearly absurd, and seems to be designed only to provoke others. It does not contribute anything to the discussion.

Just maybe this guy loved his family so much he could not bear being without them and truly believed there is life after death and probably thought he did not want his family to though being harassed and chased

 

Indeed I think he probably thought taking them with him was the best option and a means for us all to escape.

It was there for all to see until I unapproved it. Mods see posts the same way as everyone else, and at the same time. The only difference is that we have an additional menu of thread and post tools.

 

Unapproved posts can still be viewed by mods, but not by others, so they don't disappear completely.

Fair enough, how are you site team? did you get voted?

What I mean, is why cant I unapprove?
In a way you can, if you see a post that you think needs moderating all you have to do is hit the red triangle report.gif which will alert members of the site team and they'll be able to review it.

 

If everyone had the ability to physically edit other people's posts can you imagine what chaos the site would be.... let alone if a troll turned up or even worse a DCA. ;)

I think what he means is what makes a moderator a better judge of what is uncalled for than say for example me or anybody else for that matter?

 

It has been clearly illustrated to me today that such things are not dealt with fairly or even very intelligently.
