I sent the bailiffs in to RBS last month, all they did was apply to the court to have the default judgment to be set aside, stating that they 'believe they have a good chance to successfully defend the case'. And that was it. Everything went back to the submission of a defence stage. It's a complete joke that they can set aside after a judgment, it really annoyed me. Why bother having a default judgment if they can just over rule it? I'd certainly give the courts a ring as they may have already applied to set it aside. I would also phone up which ever branch you've issued the bailiffs to and tell them about the warrent of execution, that put the sh*ts up them when i called them.

I have had the same happen to me with my claim for my personal lloyds account (i am claiming for the joiunt one also). I sent an email to birmingham county court. they told me that the warrant had been granted on the 30th aug and that the bailiffs have 15 days from that date to go to the bank for the money. If they pay by cheque it can be a further 15 days before you recieve it as it has to go through the courts system first. So hopefully i should hear something this week.:rolleyes:

Ok I rang the court and they said it could take up to three weeks for the bailiffs to get my money, which although annoying is understandable. I might give their local branch a ring to see if I can scare them into transferring the money across before that date.

 

Does anyone have a direct number for the Cheapside branch, as all they have on the website is the utterly useless 0845 3000 000 number?

They do seem to be over reluctant to give out the branch numbers - i would request to be put through from the main call centre number. Which branch is it you are dealing with Optika? Is it cheapside in Hanley?

Yep, generally speaking the best course of action to get a UK branch telephone number is to call Bangalore (or wherever their Indian callcentre is located)...

Give them no mercy, find out when the baliffs are going in and ring the local/national press.

 

You have to go along to see the branch managers face, I can imagine what the rest of the customers in the bank will be thinking when they serve them...:D

Try going down to the court were the warrant was executed from to find out what is happening... you can then in person ask why the law is taking so long to act on your behalf. If you owed the bank the money they would soon be taking you to court and the court would do all it could to make you pay back the money... so they should do the same the other way round.... it is your money. Keep pushing to get it!
