    • If you have not kept the original PCN you can always send an SAR to Excel and they have to send you all the info they have on you within a month. failure to do so can lead to you being able to sue them for their failure.......................................nice irony.
    • Thank you and well done  for posting up all those notices it must have have taken you ages.. The entrance sign is very helpful since the headline states                    FREE PARKING FOR CUSTOMERS ONLY in capitals with not time limit mentioned. Underneath and not in capitals they then give the actual times of parking which would not be possible to read when driving into the car park unless you actually stopped and read them. Very unlikely especially arriving at 5.30 pm with possibly other cars behind. On top of that the Notice goes on to say that the terms and conditions are inside the car park so the entrance sign cannot offer a contract it is merely an offer to treat. Inside the car park the signs are mostly too high up and the font size too small to be able to read much of their signs. DCBL have not shown a single sign that can be read on their SAR. Although as they show photographs which were taken the year after your alleged breach we do not know what the signs were when you were there. For instance the new signs showed the charge was then £100 whereas your PCN was for £85. Who knows, when you were there perhaps the time was for 3 hours. They were asked to produce  planning permission which would have been necessary for the ANPR cameras alone and didn't do so. Nor did they provide a copy of the contract-DCBL  "deeming them disproportionate or not relevant to the substantive issues in the dispute" How arrogant and untruthful is that? The contract and planning permission could be vital to having the claim thrown out. I can find no trace of planning permission for the signs nor the cameras on Tonbridge Council planning portal. and the contract of course is highly relevant since some contracts advise the parking rouges that they cannot take motorists to Court. I understand that Europarks are now running that car park which means that nexus didn't  last long before being thrown out.....................................
    • Hi,   I am not sure if I posted this already here but I don't think I did. I attach a judgement that raises very interesting points IMO. Essentially EVRi did their usual non attendance that we normally see, however the judge (for the first time I've seen in these threads) dismissed the notice and awarded me judgement by default because their notice misses the "confirmation of compliance" paragraph. in and out in 3 minutes (aside from the chat at the end with the judge about his problems with evri) Redacted - evri CPR loss.pdf

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I sent a letter with my bank charges to HSBC nad didnt here off them, so i have sent the second letter yesterday 21st so i will wait and see and let you know how i get on fingers crossed because the chargers were very high, would be nice to get somethin:confused:

First of all isent the first letter to HSBC and thay never got back too me so i sent the leeter before action to then only last week and today i have recived aletter, my total charges with intrest were 3129.60, and thay have offered me a total of 1642.00, which i am more than happy with, so im going to sent it back to say that i accept and to take the charges back that they have charged me for this month, this money will come in so handy as im pregnant and i only have 4 weeks left well happy. will make a donation as soon as i get the money.

Are you settling for only half of what they actually owe you???! I can imagine that even this amount would come in handy but if you were to press on you would probably have the whole £3129.60 plus interest by the time your baby is a fortnight old.........that would buy twice as many nappies.

Its your money, and your right to claim it ALL!

If you only accept the offer as partial payment and tell them that you intend to continue your case for the full amount, they will probably withdraw their offer. You then fill in your moneyclaim

They WILL pay out

You WILL get it all!

This is what it says on the letter i have recived today.In circumstances where you have authorised a payment that would, if met by us, lead to your account going overdrawn or over an agreed overdraft limit, We have to condider whether to make this payment. A fee is payable for this service provided by the bank, details of which are clearly set out in our published price list. The circumstances in which the fee will apply are clearly set out in our personal Banking terms and conditiond which you were provided with a copy of when you opened youe account. If you claim for a refund proceeded to Court, we therefore believe we would successfully resist any challenge in relation to these fees.

 

HSBC is however , mindful of the management time and irrecoverable legal costs that it may incur in relation to such a claim. For those commercial reasons alone, and without any admission of liability whatsoever, HSBC is prepared to make a payment to youin the sum of £1642.00 representing the charges applied in full and final settlement of this matter, and then it just says sign and return if you accept.

You had three threads covering the same topic Kelly so I have merged them altogether in the HSBC forum.

 

HSBC have proved by making a partial offer that they don't think they stand a chance in court, so I agree with the other posters that it is only a matter of time until you get the full amount. Don't worry about it as you don't want you blood pressure going too high now. Just sit back and look forward to the better start that you will be able to give your baby.

some body help, as you know i refused the offer that HSBC made to me, any way ive has a letter today and this is what it says.

 

Thank you for your letter

 

The bank does not agree with your contention that the charges that have been inposed constitute a penalty and are therefore unenforceable. The contract between the bank and its customers is governed by our personal banker terms and conditions. In respect of overdrats, i would refer you specifically to clause 7.11 in section 2. If you authorise a payment that would, if met by us, lead your account going overdrawn or over an agreed limit the bank considers whether or not to made this payment and fee is payable for this service.

 

Our fees and charges are clearly staed in our published price list and the circumstances in which these charges will apply are clearly set out terms and conditions which you will have been provided with when you opened the account.

 

Whilst i accept that this letter will not provide the responce that you hoped for, i trust i have been able to clarify the banks position. If you are not satisfed with the banks responce you should now refer you complaints to the financial Ombudsman service, as this represents our final responce on this matter.

they are only trying to put you off of claiming in court...make you feel that u dont have a leg to stand on but thats not true. U would win in court and thats that.

 

Ignore them and press ahead!as soon as your timetable is up go straight to MCOL

 

There is not one person on this site that has lost their case but they have all had the same letter that u have had. The bank is hardly likely to say "tut, u got is fair and square!" this early on in the game...they'll push to keep your money as long as possible until they know u r dead serious about having it back.

If you are on certain benefits you can apply for exemption. You would need to go to the court office to do this and make your application there too using the N1 form. You would not be able to use MCOL.

 

Otherwise you do have to pay. You can claim that back too though.

There is no way round paying the court fee then. Is there someone you could borrow it from as you will get it back. I see your MCOL is not due until Monday, so maybe you could send them a letter over the weekend stating that as they have made an offer, which you have rejected, you recognise that they have entered into a negotiation and give them an additional 7 days in which to provide full and unconditional settlement before you apply to the small claims court. Add that this will avoid the necessity of you also claiming back the interest and any court fees that you would incur. At least this will buy you some time.

 

Hold your nerve. It is worth it for £3000+
