You will need to apply for a variation order.

Its very important to get this filed ASAP.

If your on certain benefits then you will get remission using ex160.

 

 

Form is N294

Procedure is that other side will be asked whether they accept your proposals to pay a reduced amount.

If they dont,then a short hearing will be arranged for Court to decide.

sorry about that it was 125 per month

tha debt was a b&q card santadar i ent a letter asking for late charges back they refused butagreed on 1pound per month but did not send any instuction

on how to pay. so they pased it on to cl finance. wouldent mind but the late payments came to 245 pounds the debt was only 360 pounds

ok well as a side issue

ALL of the unlawful charges can be reclaim WITH interest.

that might well clear the debt outright.

 

not sure on the legal aspect

but i'm wondering if you can get it sorted by claiming the charges back or at least telling the courts that its all charges that you are going/have reclaimed.

Yes agreed.Theres 2 options -Go for a set aside of the original decision using the arguements that they did not have any possibility to defend.

And that the amount is predominently charges-but I am not sure the Court would buy this one unless the OP could PROVE the charges and that steps were under way to recover them.

I think prob best is to go for the variation order-nothing wrong with mentioning that there are charges and steps are being taken to find out the exact amount.

Go for the charges back and in settlement tie in the issues to address everything thats gone on.
