Hi all. Thanks to you all for your continued support. I have had a warrant of execution issued and this will be enforced after this Thursday. I have a barnkruptcy hearing on 25th March to finally take the step I should have taken years ago. The Court told me to ring the Court involved and inform them when the hearing is and they should hold off until then. Is this right? Can anyone help. Urgent advice appreicated. Thanks.

I am assuming that this is a County Court Judgment that has remained unpaid and a Warrant of Execution has been requested by the creditor.

 

If so, the creditor has paid a fee for issuing the Warrant and he has entrusted the Court Bailiff to enforce the warrant.

 

It is indeed possible that the bailiff WILL agree to suspend the Warrant to await your bankruptcy...BUT if he does so, he would need to be very careful as the creditor can make a FORMAL COMPLAINT to the Court Manager on that basis that the bailiff had "lost the opportunity" to enforce the Warrant.
