    • quite honestly id email shiply CEO with that crime ref number and state you will be taking this to court, for the full sum of your losses, if it is not resolved ASAP. should that be necessary then i WILL be naming Shiply as the defendant. this can be avoided should the information upon whom the courier was and their current new company contact details, as the present is simply LONDON VIRTUAL OFFICES  is a company registered there and there's a bunch of other invisible companies so clearly just a mail address

    • You can't, but you can (and really should) bring up the point that the lender isn't meeting their legal obligations in selling the property for fair market value. You'll have to do this in court, though. A receiver is bought in by the lender, not you. If they're a registered insolvency practitioner, you may be able to raise a complaint to the insolvency service but there are no guarantees here.       On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I *know* I should take it more seriously, but I just can't. And of course, somewhere in the dark recesses of my mind, I HOPE that they don't settle and I get a chance to beat the cr*p out of them in court.... But I KNOW it won't happen... Either way, it's a win-win situation for me. :-D

Hi Heidi, just read through your thread, did you send a copy of the AQ to Adrian Ruffhead also?

 

Also, how long after the courts receive the AQ do they give you a court date? (Have you got your court date yet)?

Ohh, just had a heart attachk. No, I didn't send the AQ copy to Barclays so rang the court and the kind lady said that I don't need to send an AQ to the defense because they already do that. But I could if I wanted to?

I forgot to answer the rest of your question (as above). I have read that it takes 3 weeks to get a court date and no I haven't received mine yet... will post it when I have!!

having quite an amusing time at hte moment with mine. MCOL people have taken my schedule of charges sheet as cahoots defence LOL - hoping to apply for judgement by default on 24th October so not too far behind you.

Well, good luck with the judgement by default... I was wishing the same but a day late they filed defense. I was so not surprised though!

 

My hubby's account has just been charged £30 for going some ridiculously small amount over the overdraft. He called and I wrote a letter asking for it back... well, THIS MEANS WAR NOW!:lol:

Yayy, I finally have my court date for 25 january 2007 (11am) (I requested it be after Jan 20 as I am away). But, my form states that :it is for a preliminary hearing. This is what my notice said:

 

'DISTRICT JUDGE GRAND' has considered the statements of case and allocation questinnaires files and allocated the claim to the small claims track.

 

Before the claim is listed for hearing, the judge has ordered that a preliminary hearing should take place because:-

 

special directions are needed in this claim to prepare for the final hearing which the judge would prefer to explain to you in person.'

 

So, does this call Barclays bluff (time wasters) or do you think the jude thinks I need help??!! Mods help please!

Apologies for not replying sooner, my mother is terminally ill so now not near a computer too often. In answer to your question, and on Bookworms advice, I never did send a copy of my AQ to the defence. AQ deadline was for 12th October, we haven't heard anything back yet. Am following your thread closely (if a bit silently) so please continue to update.

Welcome to the site, you need to do a couple of things.

 

1) Read the FAQs and the step by step guides, so that you can see what you're getting into (don't worry, so far no-one's been to court AFAIK) - basic process for Barclays seems to be :

 

a) Subject access request (to get your charcge info)

b) Preliminary letter

c) Letter Before Action (LBA) - threatening court if they don't pay up

d) 50% offer from Barclays

e) Claim through Moneyclaim Online (MCOL) or at your local court (at this point add 8% statutory interest & costs)

f) Barclays submit defence

g) Receive allocation questionnaire (AQ)

h) Wait for court date to be issued

j) Wait until a few days before court date

k) Get settlement from Barclays

l) Go to the pub and celebrate on Barclays

 

If you already have your statements going back 6 years you can skip a)

 

2) Read up on as many of the threads on here as you can (look for the longer ones as they have a more complete story running through them.

 

3) Start a new thread in the Barclays folder called "Hannahlt vs Barclays" and use it to keep all your posts together - this way future users will be able to follow your story just like you did in step 2 above, and also it is a useful way of keeping track of your claim (you will have noticed that Barclays dig their heels in at every stage and the claim can take a couple of months). If you need any help you can post any questions in there and someone will be able to help

 

4) Once you've created your thread, you'll see a link above yor first post that says "Permalink", click that and then bookmark the page, that way you don't have to keep paging through everyone else's post to get to your thread.

 

5) Send your letters to Barclays head office in London:

See, you don't even need a stamp! But once you get a bit down the line you may want to use recorded delivery (cost about 60p)

Hi, Heidi! Sorry, as you rightly gathered, I have been busy busy busy (holidays? What's that? Oh yeah, that's the time where my brats are actually diverting me from this site, lol)

 

Prelim hearing? Yeah, there's a few of them around. But what for, who knows... I suspect he might be on the ball and try to force a faster settlement from the bank, he might want to decide about standard disclosure... There could be a range of reasons why. Don't let it worry you.

 

Remember you can always call the court and ask them what it means, they are usually very helpful and will reassure you where they can.

 

Try to arrange to visit the court, see if you can sit in on a hearing, it makes all the difference if you can see for yourself that it is nothing like what we imagine (Old Bailey's, long black gowns, horsehair wigs, etc... NOTHING like that, lol!!!)

 

Making a note in my diary now ;-)
